As of 1 June 2025, employers employing foreigners are obliged to send copies of their employment contracts to the office. The problem is that the ICT system, which was to enable this request to be met, is inactive not working. How can entrepreneurs fulfill their obligation?

New regulations, no tools

In accordance with the Act on the Conditions of Acceptability of entrusting work to foreigners in the territory of Poland, from the beginning of June, employment contracts signed with foreigners should go to the office which issued the work licence or entered a declaration of entrustment of work in the register. The transmission of papers was to take place electronically, but the Ministry of Family, Labour and Social Policy did not have time to run the strategy on time, according to the diary of the Newspapers.

Moreover, the ministry's message shows that the platform can only be made available on holiday. Meanwhile, entrepreneurs were placed in a situation where they had to carry out their work without a tool to execute it.

Business Frustration

– Entrepreneurs must, alternatively of focusing on their business, consider how to avoid being liable for them,” says Michał Podulski, Vice president of the employment Agency Association, quoted by the “DGP”.

This situation raises questions of liability for possible legal consequences. Will companies be punished for not sending out contracts if they do not have the method ability to do so? Does the ministry supply for a transitional period during which penalties will not be imposed?

For now entrepreneurs stay in doubt. The deficiency of clear guidance from the ministry can lead to legal chaos. It is worth following authoritative messages and, in case of doubt, consulting lawyers specialising in labour and migration law.
