Thus, the IPN authorities have one more time broken even this foolish and harmful law under which they have been sowing the work of demolition for years. Article 5a(1) of the alleged Decommunization Act states that “The Memoirs may not commemorate persons, organizations, events or dates symbolising communism or any another totalitarian government or otherwise advance specified a system.” However, the contents of the boards in no aspect were referring to persons, organizations, events or dates symbolizing communism or any another totalitarian system. On the first was the inscription: "On 24 June 1944, soldiers of the youth battalion of the People's Army "Thursday" amazed by many more Nazi troops fought with him victorious". However, apart from the political and ethical assessment of IPN activities, it is worth looking at their legal aspect. The Constitution of the Republic of Poland states that public authorities operate on the basis and within the limits of the law. This besides applies to hunwabins from the IPN. Therefore, the application of the absurdly extended explanation of the previously indicated decommunation law constitutes an abuse of power which in itself is simply a violation of the law. This case is described in Article 231(1) of the Criminal Code, which states that “a public officer who, in excess of his or her powers or failing to fulfil his or her duties, acts in the public or private interest, is subject to imprisonment of up to 3 years.It’s okay. ” The same KK in Art. 288 §1 states that “whoever destroys, damages or renders unfit is subject to imprisonment from 3 months to 5 years”.
