District Court in Warsaw rejected the complaint of the judaic association B’nai B’rith on the prior decision to discontinue proceedings against Fr. The case afraid the words of the priest who died during the lecture in 2018, on charges of ritual murder. He said that there were final sentences in these cases, so they should not be underestimated.

The Jews lost to Father Guz in court. It was a ritual. The territory Court stated that priest Guz had exercised constitutional protection of freedom of expression. Moreover, evidence shows that the clergy had no intention of insulting or insulting the judaic nation, nor of calling for hatred in respect to this community. The order is final and the costs of the proceedings are borne entirely by the B’nai B’rith Lodge.

The association claimed that in its words on ritual murders, a clergyman called for hatred against national and spiritual differences towards the judaic people, and consequently publically called for alleged "anti-Semitism".

The proceedings were originally dismissed by the territory Court for Warsaw – Żoliborz in May this year. He claimed that Fr Guz was distributing false information, controversial and perpetuating the “false image of Jews”. The Plenipotentiary requested that the contested provision be repealed in its entirety and that the substance be referred to the court of first instance for further proceedings.

Finally, on September 10th, the territory Court in Warsaw, recognizing the complaint, retained the ruling of the territory Court and charged the prosecutor with the costs of the proceedings. On the basis of the order, the court pointed out that the defendant’s conduct did not exhaust the evidence of the actions alleged by the indictment. This is evident from both the content of the evidence gathered in the case and the description of the action. The Court of First Instance held that the defendant's arguments were based solely on an unauthorised argument with the findings of the court of first instance.

According to the court, priest Guz had the right to freedom of expression in the course of discussions of a technological nature, besides to express his views. He felt that the clergy had exercised the constitutional protection of freedom of expression. His conduct was in no way enmity with the judaic people, and so much so could there be no hostile, intentional attitude of racial or spiritual origin.

As part of the fight against historical truth, the judaic organization besides directed an indictment against the employees of the Catholic University of Lublin, who dropped the investigation into the case of Fr Guz. In this case too, a final decision to discontinue proceedings was given.

The order of the court in the case of priest Guz is very important, as it shows that Jewry does not yet have specified influence in Poland to institutionally suppress freedom of expression in order to hide the fact about historical judaic crimes.
