The Warsaw territory Court is investigating the case of Mariusz Kamiński, Maciej Wąsik and another erstwhile heads of the Central Anti-corruption Bureau (CBA) who were convicted in 2015 by the territory court for their actions in the alleged "ground affair". The case returned to court after more than 8 years due to the June ultimate Court ruling. A typical of 1 of the auxiliary prosecutors reported that defence speeches were received today, and the announcement of the conviction will be public on December 20.
In early June this year, the ultimate Court in the Criminal Chamber annulled the dismissal of the case of erstwhile CBA chiefs, which was made in March 2016 by the territory Court in Warsaw. This remission was the consequence of president Andrzej Duda's application of the right of grace to the unofficially convicted erstwhile CBA chiefs. The ultimate Court referred the case to the territory Court for reconsideration, which led to the present hearing.
The case of erstwhile CBA bosses has a nearly ten-year history. In March 2015, the Warsaw-Śródmieście territory Court sentenced at the first instance of Mariusz Kamiński and Maciej Wąsik to 3 years in prison, among others, for exceeding the powers and illegal operations of the CBA during the "ground affair" in 2007. Penalties after 2.5 years were received by 2 another erstwhile members of the CBA management. Kamiński criticized the judgement at the time, recognizing it as "a clear sense of justice, curiosity, grossly unjust and incomprehensible".
The appeal hearing, held on Tuesday, lasted about 2 hours and was conducted in secret, without the participation of the public and the media, in a peculiar hall for secret hearings. However, the ruling is planned in a “normal” courtroom and is to be public. The prosecutors' attorneys informed the media about this after leaving the secret sitting.
After the proceeding was concluded, the counsel Jacek Dubois expressed his hope of ending the trial after so many years and stated that the situation for justice seemed to be good. He besides stressed that the transportation of the judgement on 20 December would be public, in accordance with the rules of procedure, which would let citizens to find out precisely what had happened. On the another hand, the Lepper household lawyer noted that the court would request time to analyse many documents, both in terms of trial and the right of grace issued by the President.
