On 23 September 2022, president of Law and Justice (PiS), Jarosław Kaczyński, met with residents of Łódź, where he discussed the issue of a fresh constitution for Poland. According to him, the fresh constitution should be the basis of the fresh state organization and a sign that "we already have a fresh Poland". Kaczyński stressed that the fresh constitution must supply adequate safeguards to guarantee the appropriate functioning of the state.
The draft fresh constitution must besides propose "extraordinary safeguards – those which are not in another constitutions". As Kaczyński said, all constitution acts in the sphere of a certain culture, customs or common law. Therefore, the draft fresh constitution must take these aspects into account in order to guarantee the appropriate functioning of the state.
PiS president added that 2 thirds of Parliament's vote is required to change the constitution, which is "not easy to get, so we must besides look for another options". As he said, it's not about breaking the constitution, it's about admitting that the constitution at the minute is practically non-existent.
Kaczyński besides said that the current constitution was built under peculiar circumstances. First everything was done only so that Lech Wałęsa would not gain more power, so as much as possible take the president and hand him over to the government. Later, erstwhile Aleksander Kwasniewski became president, the road was the another way. According to Kaczyński, specified actions resulted in the creation of a constitution of "a terrible structure, denying itself, creating conflicts".
According to data from the Central Statistical Office (GUS), in 2020, 73.4% of Poles were in favour of changing the constitution. In turn, 55.1% of respondents believe that the fresh constitution should be adopted by referendum.
It is besides worth noting that in 2020 the Sejm adopted a resolution on the adoption of a fresh constitution. This resolution calls on the government to start work on a fresh constitution to be adopted through a national referendum.
