An entrepreneur from Podhala, Adam Biedron, over the years paid off taxation arrears in instalments, until abruptly the taxation office seized all his accounts. The man went to the hospital, and the lawyers pointed to gross violations of law. The case is pending.
Adam Biedron has been moving a clothing company for over 20 years. In 2022, by investing privately in financial instruments, he made a crucial profit, which he completely lost a year later. Still, the IRS charged him 730 1000 zł of Belka tax.
– I had nothing to pay for, but I never avoided commitments. I wanted to pay them fair and square. – says the entrepreneur.
Acceptance of instalments, abrupt change of decision and execution
Biedron obtained the approval of the office to spread the payment into instalments. For many months, he paid off his debt on schedule. However, as the last, highest payment (PLN 250 thousand) approached, he was called in for a conversation with the politician of the Treasury.
– The warden questioned that part of my private debt was invested. I blew up due to the fact that it was my money, not theirs. – reports the entrepreneur.
Soon after the office rejected his application for instalmentsAnd the decision came after deadline. By the time the paper got to Biedron, IRS took all of his accounts, including investment, and counted 100 1000 PLN execution costs and interest.
Serious violations and fighting in court
Lawyers of entrepreneurs indicate many irregularities:
- no reminder of execution,
- issue a decision after the deadline,
- to prevent appeal.
This is an act that denies a citizen's trust in the state. – 1 of our experts evaluates.
The case went to Provincial Administrative Court in Kraków. Biedron demands reimbursement of the costs of execution and compensation for the failure of funds.
– I'll fight for justice. My company, my household and my wellness suffered. All due to authoritative stubbornness – says the entrepreneur who went to the infirmary after these events with cardiac problems.
Have officials exceeded their powers?
The issue raises questions about the limits of fiscal action and the protection of taxpayers' rights. Can the IRS arbitrarily retreat erstwhile findings? Are entrepreneurs left alone in a fight with an authoritative machine?
The result of the process may be applicable to thousands of another taxpayers.
