Boris Budka violates the European Parliament's rules on Eva Zajączkowska-Hernik's request to retreat the Building Directive

On 14 November 2024, Ewa Zajączkowska-Hernik, associate of the European Parliament, together with Members from the groups of: Europe of the Sovereign Nations, Patriots for Europe and European Conservatives and Reformists, submitted request pursuant to Article 47 of the Rules of Procedure of the European Parliament. It concerns withdrawal from the EPBD Energy Performance of Buildings Directive, which imposes a number of costly and hard to implement building energy performance requirements. This directive provides, among others, that all fresh buildings are to become carbon-free by 2030 and already existing by 2050. For fresh public buildings, the deadline is 2028.

5 December, during a press breakfast (entry, video) Ewa Zajączkowska-Hernik presented the proposal to the media and indicated that the introduction of these requirements in the face of the housing crisis in Europe and rising property prices poses a serious threat to Poles and another citizens of the European Union. In line with the Directive, if these requirements are not met, sanctions are besides provided for, which can further burden the household budgets of citizens, especially those facing financial difficulties.

On 16 December, the president of the European Parliament, Robert Metsol, requested that the Building Directive be withdrawn from the ITRE Committee (Committee on Industry, investigation and Energy).

The proposal to retreat the Directive met with opposition from any politicians, including ITRE Commission president Boris Budka, who alternatively of allowing all the authors of the proposal to make a public appearance before the full committee, he sent an email via the ITRE Secretariat on January 27, inviting only 1 typical to an eye-closed gathering of the committee coordinators – January 29 at 9:00. specified action was considered by authors to be an effort to reduce transparency and transparency of the decision-making process.

In consequence to this invitation, Ewa Zajączkowska-Hernik submitted a message announcing that no of the authors would attend a secret gathering and I anticipate a deadline for public proceeding and debate before the full ITRE committee, in accordance with the EP rules. Instead, it considers the proposal as an effort to reject the proposal in a non-transparent and undemocratic way, which constitutes an act of discrimination against opposition groups in the European Parliament.

Article 47 Rules of Procedure indicates precisely:

The committee liable shall decide on the follow-up within 3 months of the transmission of the request, after allowing authors to apply before the committee.

"Instead of letting us have an open and honest debate before the committee to present our proposal, The booth and European mainstream politicians panicked and chose a way that violates the European Parliament's rules of procedure. This action aims to hide this crucial substance from the public, which is absolutely unacceptable. In Poland, Rafał Trzaskowski and KO politicians talk about the request to revise the Green Deal, while we make specified a effort in Brussels, their denominations want to reject our proposals quietly, behind closed doors. This is their liberal democracy" – notes Ewa Zajączkowska-Hernik.

The actions of the president of the ITRE Commission rise serious doubts about the intentions of the politicians of the Civic Coalition and their incredible announcements of revision of the objectives and assumptions of the Green Deal in the context of the upcoming presidential elections in Poland. Ewa Zajączkowska-Hernik emphasises that transparency and public debate are crucial to avoid decisions that may have serious financial consequences for citizens, while at the same time having to be taken in a manner consistent with the principles of the democratic legislative process.

Member of the EP Zajączkowska-Hernik declares that he will not quit the substance and will proceed to fight for the interests of Poles at the level of the European Parliament. She announced a complaint to the president of the European Parliament to Boris Budka's gross breach of the rules of procedure and further effort to reduce transparency in this matter.
