A spokesperson for SMEs is alarming: more and more entrepreneurs are losing sick and maternity benefits due to late 2022. ZUS refuses to pay, although contributions have been paid – even with a slight delay. Why is this happening and how to fight for your rights?

ZUS verifies contributions from years ago – entrepreneurs in a trap

The Ombudsman of tiny and Medium-sized Entrepreneurs receives dramatic reports concerning the decisions of the Social Insurance Institution, who refuses to pay benefits. Reason? deficiency of sickness insurance for the period prior to 2022, even though contributions were paid – although sometimes with small hold or underpayment.

The problem is that:

  • sickness contributions were paid after the deadline,
  • there was a fewer gold underpayment,
  • the records in the ZUS account have changed (e.g. due to court settlements or changes in the insurance scheme).

Before 2022, the deficiency of a timely payment meant an automatic exclusion from insurance. The entrepreneur could then submit a request for approval to pay the arrears, but the decision belonged only to ZUS. In the event of refusal, only a long-term and costly judicial way remained.

New regulations since 2022 – has anything changed?

More favourable regulation was introduced in January 2022:

  • entrepreneurs shall not lose their entitlement to benefits if the underpayment does not exceed 1% of minimum wage,
  • The strategy was to be more transparent and legally stable.

Unfortunately, in practice ZUS inactive refuses to pay, arguing that for the period before 2022 the entrepreneur had no insurance. Worse still, many of them were not informed of this fact, even though they regularly paid contributions.

Dramatic consequences – no benefits in illness and pregnancy

The effects of specified a policy are serious:

  • entrepreneurs in long-term illness do not receive benefits,
  • pregnant women lose maternity benefits,
  • Even winning in court does not warrant immediate financial assistance.

The SME spokesperson, Agnieszka Majewska, emphasises:

‘In the country of law, it is unacceptable that changes in the account of an entrepreneur operated by the Social Insurance Institution consequence in his being expelled from sickness insurance many years back. specified actions destabilise the legal situation of entrepreneurs and negatively affect citizens' assurance in the state."

What's next? SME spokesperson announces intervention

In view of the scale of the problem, the SME Ombudsman considers:

  • General intervention against ZUS,
  • Proposals for amendments to the lawwhich will permanently safe business interests.

  1. Check that the underpayment did not exceed 1% of the minimum wage.
  2. Make an appeal against the decision of the Social Insurance Institution.
