The deregulation squad chaired by Rafał Brzoski proposed crucial changes to the rules on legalisation of building self-services. A key proposal is to shorten the period for legalization of specified facilities from the current 20 to just 10 years. Does this mean a revolution in Polish construction law?

Why is change needed?

Currently, the owners of buildings erected without required permits can only benefit from the legalisation procedure after 20 years of completion of the investment. As reported by Rzeczpospolita, the Brzoski squad advocates a half simplification of this period, arguing that the current government discourages owners from taking legalization measures.

"Many people are afraid of having to pay extra fees or carry out costly construction work, leaving the buildings built voluntarily in a position to endanger users," the originator explains. The shortening of the legalisation period is intended to make it easier for property owners to formalise their position as well as to improve the operation of construction oversight inspectors and courts.

What's next with the proposal?

For now, the proposal is at the discussion stage. It is not yet known whether or in what form it will be accepted into the applicable legal order. However, it is already of large interest among both real property owners and construction experts.

Deregulation of the economy under scrutiny

Rafał Brzoska, president of InPost, was appointed by Prime Minister Donald Tusk to prepare plans for deregulation of the Polish economy. Within just 7 days, the squad under his direction created a group of respective 100 volunteers, experts and officials, whose common imagination of changing the state's bureaucratic machine.

Migrants and the labour market

One of the points of this plan is the changes in the employment of foreigners. The Brzoski squad calls for the resignation of a provision which "requires Polish companies to employment foreigners exclusively for a contract of employment".

"Equality in access to different forms of employment: By limiting foreigners only to employment contracts, an unjustified difference is made in the treatment of workers on the basis of their nationality. This is contrary to the principles of equal treatment, which are the foundation of labour law and modern democratic standards" - emphasised the squad of the ReviewWe.

In addition, experts point out that current regulations may negatively affect the competitiveness of Polish companies. "Provisions that force employers to usage a single form of employment for foreigners may lead to companies' reluctance to employment abroad workers. This in turn may negatively affect the competitiveness of Polish companies, which usage global talent to strengthen their innovation and competitiveness on the global market" - the analysis states.

Summary

The proposals of the Deregulation squad under the direction of Rafał Brzoski can bring crucial changes in both construction law and the labour market. The shortening of the period of legalization of building self-services and changes in the employment of foreigners are only any of the demands that aim at facilitating the lives of citizens and entrepreneurs. Will these proposals be implemented? Time will tell.
