Zbigniew Ziobro challenged Adam Bodnar – there will be a trial

The "Fighting Giants" is simply a phrase derived from publishing, mainly sports, but in this case it is reflected in facts and individuals. Zbigniew Ziobro, erstwhile Minister of Justice and lawyer General, unparadoxedly attacked Adam Bodnar, the current Minister of Justice and the lawyer General calling him a "bandit" and "gangster". This is 1 of the highlights of the fresh days, the death of the legendary “Mrs. Basi”, or Barbara Skrzypek, who for 30 years was the closest contributor to Jarosław Kaczyński.

Emotional uproar takes place in paragraphs, doctrine, and jurisprudence, and political opponents surely provided Zbigniew Ziobrze with quite a few emotions, even those of the most vile species, erstwhile they challenged his cancer illness to make blind political vengeance. On the another hand, the erstwhile minister was besides able to be very clear in his behaviours and speeches for many years, so we can talk about the emotional agitation of the other party. Emotions, however, are not the basis of a legal process, in which the facts and the letter of law should be the first thing that matters, although we all know that this is unfortunately a theory.

In practice, there is "a dispute in doctrine", especially in political-colored processes. The first doctrine is that policies and wider public people must have "fat skin", which means that criticism of them is greatly extended. The most liberal doctrineists, including the judges of the European Court of Human Rights, even let policy-makers to be challenged, but that is the case that this approach mostly concerns right-wing politicians. The second doctrine is that always and everywhere the limits of acceptable criticism must be preserved and these are social norms, the culture of saying so on.

In addition, there is another cult doctrinal war in which scribes argue what facts and what assessments are. What's the large deal? Another explanation of the law, namely that defamation refers only to the realm of facts, while the assessment of facts, even beyond the limits of the culture of expression, is acceptable. Let us now quote Zbigniew Ziobro's entry and stand up as a just judge:

.@AdbodnarOh, my God! Yeah, you're a gangster and a thug. You're asking why due to the fact that you took over the National Prosecutor's Office with violence. You're preventing a legitimate national prosecutor from doing his job. In his place, along with Tuski, you appointed an illegal usurper. Without the required bill...

From the first to the last sentence, it is clear that Zbigniew Ziobro is agitated but besides aware of the words he uses. In addition, the harsh wording ‘bandit’ and ‘gangster’ is simply a confirmation of his earlier statements and there is no uncertainty in this respect. However, in the remainder of the entry there is simply a full list of facts and this is definitely unfavorable for Adam Bodnar. In conclusion, Zbigniew Ziobro clearly uses very strong words and widely regarded as pejorative, but these words constitute an assessment of Adam Bodnar's behavior, which in turn are far from any legal standard, not to mention the standards that the Minister of Justice and the lawyer General should represent. How will this end? Which doctrine will win? What letter of law will prevail?

All taken together does not substance much, due to the fact that in specified processes judgments give fate, with or without the aid of the drawrs. Zbigniew Ziobro will hear that he is guilty of defamation, if it is simply a defamation trial, or will be acquitted, depending on what justice jumps out of the draw machine. And absolutely nothing will change that sentence, the most striking facts and evidence, the apparent letter of law, or the equally clear circumstances of the case. Given the current legal and political realities, Zbigniew Ziobro has no more than 10% chance of a favorable sentence, but he promised that these realities are to change, so we must be patient and wait what fate, or alternatively a draw, will bring.

We don't believe in anyone, we don't believe in anything! We look at facts and draw conclusions!
