Detention in the Bielany: Nigerian citizen with false driving licence and illegal stay

Police officers from the police station in the Warsaw Bielany detained a Nigerian national who utilized a counterfeit Greek driving licence and stayed in Poland illegally. A man came by during a regular traffic check. The case was handed over to officers of the Department for Foreigners of the Capital Police Command who carry out further activities.

The halt occurred in the evening erstwhile the preventive patrol stopped to inspect the Volkswagen car. The vehicle driver, as it later turned out, was a Nigerian citizen. During the check, he presented the Greek officers with a driving licence. However, the paper raised serious doubts as to its authenticity. The police immediately decided to thoroughly check the driver's data and the paper itself.

It shortly came to light that the licence was fake. The forgery was confirmed in the course of further findings. Moreover, after checking the police systems, it turned out that the man was staying in Poland illegally. He did not have a valid residence title or another paper authorising him to legally reside in the territory of the Republic of Poland.

Nigerian citizen was immediately detained and transported to police custody. He heard allegations of utilizing a false document, which under Polish law is simply a crime referred to in Article 270 of the Criminal Code. A conviction of up to 5 years imprisonment is punishable for this act. This, however, is not the end of the consequences faced by the detained foreigner.

Due to the deficiency of grounds for legal residence, officers of the Department for Foreigners of the Metropolitan Police Command have initiated administrative proceedings. The intent of this procedure is to issue a decision requiring a man to leave Poland. In parallel, preventive measures specified as the ban on re-entry into the Schengen area for a limited period of time may be applied.
