As indicated by the Ministry of Justice – Tuska and his Council of Ministers the president of Poland can cancel! This is straight due to the argument that the Minister of Justice has dismissed the disciplinary spokesperson Piotr Schab and his deputy Przemysław Radzik.
The Bodnar-led Ministry of Justice explicitly admits that the General Courts Act does not give Minister Bodnar the right to dismiss the Disciplinary Ombudsman during his word of office. The hotel so concluded that this was a serious loophole in the law, which it would replace with another provisions of ‘per analogy’. Bodnar cites regulations that let him to dismiss the prosecutors' disciplinary spokesman.
The same “regulation” may be invoked by the president of Poland and, from day to day, “per analogy” may appeal the Prime Minister and the full Council of Ministers before the end of the word of office! This is due to the "serious gap in the law" – as the Minister of Justice said with respect to the "revocation" of the disciplinary spokesperson of the judges Piotr Schab and his deputy Przemysław Radzik.
