The European Commission has published a study on the implementation of the EU Pact on Migration and Asylum. Contrary to reports and claims of any politicians and journalists, Poland will not be exempt from participation in the solidarity pool, but can only apply for exemption from participation in this mechanics in full or in part, in the coming year. Poland, like Germany, France and the Baltic States, has been described as “a country exposed to migration pressure”. The final decision to exempt Poland from participation in the solidarity pool belongs to the Council of the European Union.
Tusk lied to Poles about the Migration Pact. As described by the Ordo Iuris Institute, On 11 November, the European Commission published a communication on its implementation. The paper was prepared on the basis of Article 9 Regulation 2024/1351 (one of the 10 legal acts of the Pact on Migration and Asylum), according to which it adopts a study erstwhile a year, presenting the situation of asylum and migration in the European Union and in the associate States and presenting the state of implementation of the EU Pact on Migration and Asylum in the last 12 months.
This means that, on the basis of the arrangements contained in the Agreement, pursuant to Article 12 of Regulation 2024/1351, The European Commission is submitting a proposal for a Council implementing act on the establishment of an yearly solidarity pool, i.e. the number of migrants in request of relocation and the degree of financial and operational assistance needed by countries in hard immigration. The study is so very crucial for the current migration policy of the European Union, the general principles of which are set out in the Pact.
Part of the Communication describing the current degree of implementation of the EU's migration and asylum Pact government indicates that associate States, supported by the Commission and applicable EU agencies, "step up efforts to translate the legislative agreement into applicable reality and guarantee that their national asylum, reception and migration systems are ready to full apply the Pact by June 2026" (p. 5). At the same time, it highlighted that there was "general request to accelerate the pace of reform" (p.5).
The authors point out that the current implementation of the Pact's provisions focuses on adapting regulations, applicable implementation and providing resources for improvement in this area. They emphasise that fresh challenges arise in this area with respect to the implementation of Eurodac (a centralised strategy containing a biometric database of asylum seekers and illegal immigrants), the establishment of a common border procedure and the request to supply the essential infrastructure, staff and administrative solutions.
The EC informs that more than 110 000 people were refused entry into the EU in the time period described in the Communication, and the most absolute refusals were recorded in Poland, Croatia, France and Romania (p. 10). Most of the refusals afraid citizens of Ukraine, Albania, Moldova and Turkey.
The Commission presents forecasts of migration and asylum phenomena for the coming year. It was pointed out that in 2026, compared to 2024, the number of illegal arrivals on all major migration routes is expected to decrease. The projected decline is due to the strong commitment of the Union in key countries of origin and transit, enhanced asylum and border protection systems and enhanced action against migrant smuggling networks both within the Union and in 3rd countries.
As regards the east border of the EU, the Commission reports that Russia and Belarus will most likely proceed to effort to usage migration as a weapon against the Union. However, enhanced border management is expected to further reduce the number of illegal crossings on this EU external border section.
The EC points out that the countries qualified for the category of "country under migration pressure" are Cyprus, Greece, Italy and Spain. This categorisation, in the EC's assessment, is due to the fact that these countries are facing disproportionate problems in relation to the overall situation in the European Union. The 4 associate States will so have access to the solidarity pool erstwhile Regulation (EU) 2024/1351 enters into force.
As countries exposed to migratory pressures, the group of 12 countries, including Germany, France, Poland, Lithuania, Latvia and Estonia (p.21). It besides indicated that Bulgaria, the Czech Republic, Estonia, Croatia, Austria and Poland are facing a serious migration situation, which shows the cumulative impact of quantitative and qualitative data and information collected and assessed over the last 5 years. The paper stresses that "These associate States will be able to request the Council to deduct their solidarity contributions for the coming year in full or in part" (p. 24).
This means that Donald Tusk lied, saying that Poland was completely exempt from the forced admission of the chaotic peoples of Africa and Asia. At most, he can be released from this work temporarily for a year if the EC kindly agrees.
