The Court of Justice of the European Union refused on 29 September 2026 to suspend a decision allowing the provisional application of the EU trade agreement with Mercosur, in force from 1 May. Jadwiga Wiśniewska from PiS called the consequence a disgrace to Donald Tusk's government. For Poland, this means further competitive force on farmers before the verdict in the main case.

Poland showed no irreversible injury

On 29 September, the Vice-President of the Court of Justice of the EU issued a resolution in Case C-460/26 R Poland v Council. Poland demanded that the implementation of the Council decision be suspended, which allowed the provisional application of the commercial part of the EU agreement with Mercosur. From the authoritative TEU message it follows that the Interim Agreement has been applied since 1 May 2026.

The Court of Luxembourg considered that the Polish application did not contain concrete evidence to show the likelihood and proximity of serious and irreparable damage. In the Court's assessment, Warsaw did not supply detailed data on the financial situation of farmers, which would confirm that competition with Mercosur goods would force them to halt operating. General warnings were not enough.

Wiśniewska incriminates the Tusk government

Jadwiga Wiśniewska, a associate of the PiS for the European Parliament, said in Radio Mary that this justification was compromised by the government of Donald Tusk, represented by the Minister of Agriculture. The politician pointed out that European agriculture is already losing its competitiveness and that the full effects of the agreement may aggravate its problems.

Her charge falls to a weak point in the cabinet's operations. The government declared opposition to the agreement, but did not convince the Court that the harm was sufficiently specific, close and irreparable. This is simply a serious trial failure, even if it doesn't find the result of the case yet. Before President Karol Nawrocki called for the defence of the Polish countryside against the effects of Mercosur.

The order does not end the Polish complaint

Two issues request to be clearly separated. The TEU has not now ruled that the Council's decision is legal. He rejected the application for an urgent suspension of the complaint. Poland continues to request annulment of the decision authorising the provisional application of the agreement.

The Court besides pointed out that agricultural goods from the Mercosur countries could have been imported into the Union before and are subject to EU sanitary regulations. He besides noted that the EU has protective measures in place in the event of serious threats to human, animal or plant health. That's the court's legal argument. It does not remove the political question of the difference in production costs, the scale of competition or the effectiveness of safeguards for farmers.

Food safety in Poland is at stake

The Mercosur agreement cannot be assessed solely by the prism of cheaper imports. Agriculture gives you resilience to crises, jobs outside the largest cities and the ability to feed citizens on your own. Polish producers have been informing against unequal conditions of competition for months. These concerns should be translated into hard data and an effective process strategy.

Brussels opened the marketplace and the Polish government lost the first effort to halt this decision. Now evidence is needed, precise calculations and building coalitions of states that want to defend their own agriculture. The opposition itself expressed at conferences will not defend farms or wallets of Poles.
