The government draft budget for 2027 omits the gross and expenditure of the Constitutional Court, although the plan of the Constitutional Tribunal amounts to PLN 78.05 million. president Bogdan Święczkowski handed him over to the Sejm on 30 September, acting as he wrote, "in a state of higher necessity". Without an amendment of the parliament, the constitutional body will be without its own budgetary part.

Plan for PLN 78.05 million outside the state budget

The draft budget law for 2027 does not cover the Constitutional Court section. Documents adopted by the Government and forwarded to the Council for Social Dialogue The Ministry of Finance published on 28 August. There is no income and expenditure plan for TK. The Court planned PLN 78.05 million for next year.

This is the next phase of the dispute we have written about after first decision of the government to leave the TK outside the budget. Finance Minister Andrzej Domanski maintains that he did not receive a paper gathering the statutory requirements. The government cites the deficiency of a resolution of the General Assembly of Constitutional Court Judges.

Święczkowski: a state of higher necessity

Bogdan Święczkowski sent a draft plan on 30 September to the Marshal of the Sejm Włodzimierz Czarzaste and all the Deputy Marshals. He asked the Members to present the paper and to proceed with the work on the state budget. The president of the Constitutional Tribunal wrote that he acted ‘in a state of higher necessity’ as the government did not take the Court's backing into account.

Święczkowski stated that he had twice headed the draft for the General Assembly. The resolution was not adopted due to the absence of a quorum. According to the president of the Constitutional Tribunal, this was due to the obstruction of 2 judges. It's his assessment of the origin of the deadlock, not the uncontested fact. However, the deficiency of resolution itself remains a fact and the government builds all the arguments on it.

The Act confers on the General Assembly the power to enact the draft gross and expenditure of the Constitutional Tribunal. The Minister of Finance is then to include specified a plan in the draft state budget. Święczkowski responds that in many years of practice the plan was passed on to the ministry before the adoption of the resolution, and approval followed. The dispute so concerns the effectiveness of the submission of the document, but the consequence may be a real cut-off of the institution from the money.

Black man refuses, though the Sejm can change the project

Vladimir Czarzasta refused to broadcast the race. He pointed out that the legislative initiative on the budgetary bill belonged exclusively to the Council of Ministers and that the plan was not passed by the General Assembly. The Marshal so responded to the procedure and sent the burden of action back to the government.

This attitude collides with the words of Deputy Finance Minister Hanna Majszczyk. During the session of the Sejm on 3 September, she said that if the General Assembly did not accept the plan, Parliament had the tools to supply backing for the institutions. Official seismic transcript He doesn't leave any guesses here. If the Sejm can remedy the deficiency of a government project, Blacksmith's refusal is simply a political decision taken under the existing procedure, not a legal proof of helplessness.

♪ In the background ♪ wider government conflict with Bogdan Święczkowski and the Court. Donald Tusk's office questions the current form of the TK, and the president of the Court accuses power of attempting to paralyze a constitutional body. The dispute over the cast and legitimacy of the institution was transferred to the public finances.

State continuity is at stake

The budget of the Constitutional Tribunal shall be maintained by the full institution: the employees of the law firm, legal services, building and statutory benefits. Detention of backing is not a sanction imposed solely on respective judges. It affects the ability of the State body to execute its tasks and to regulate its obligations.

Poland needs to fix constitutional governance, but it must not be carried out by means of financial extinction of institutions. Today, most may find specified a measurement convenient in the fight against their opponent. A akin precedent can be utilized against another independent body tomorrow. For Poles it is at stake to be certain that the state acts according to the law besides erstwhile the rulers do not recognise the political legitimacy of its parts. The Sejm should settle the substance openly, during budget work, and take full work for the decision.
