Despite the political declarations made on the improvement of justice, the absence of change is gross. The same groups of interests and arrangements proceed to exercise control. Will we finally, after years of failing, have a genuine redevelopment of the judiciary system? There's quite a few points to that, no.
Joanna U. threatens to punish up to 8 years of imprisonment in the court trial in Ostrołęka, where she is charged with stealing money, gold and silver, despite deficiency of concrete evidence. Cases involving her illustrate that pathological mechanisms in the judiciary have not changed.
Joanna U.'s communicative began dramatically in 2020, erstwhile she filed for divorce after 24 years of matrimony to Andrzej P. She claimed that he was the perpetrator of physical, intellectual and economical force against her and her children. The court acknowledged the divorce by both parties, listing home force as the main reason for the dissolution of the marriage. Despite this, the court refused to safe kid support, arguing that the parent had the means to keep them. In addition, the court prohibited the ex-husband from approaching his son, Alexi.
But that wasn't the end of Joanna's problems. Andrzej P. reported to the prosecutor's office the theft of his money, gold and silver and applied for the annulment of the property union. Shortly thereafter, he besides accused Joanna of stealing, although there was no evidence to support these allegations. The D.A. has charged Joanna on the basis of the evidence of Andrew himself, despite the deficiency of another evidence.
According to a announcement sent by Andrzej P. to the D.A., his ex-wife allegedly stole his money and gold coins, which were stored in their home (which was the consequence of a joint operation). Despite the deficiency of division of the company's assets, Andrzej P. voluntarily assigns himself the right to the full property. However, these claims of theft are not supported by any evidence. No supporting documents, witnesses or recordings – absolutely no evidence. However, the prosecutor who was investigating the case decided that there was a robbery and that Joanna U. was charged. In 2020, Joanna U., fleeing force from her ex-husband, transferred any of the money from a joint account that the prosecution included in the indictment.
Close social relations are a substance of concern. erstwhile lawyer representing Andrzej P. was a privately good friend of the judge. In the courtroom, she referred to the leading justice by name. Andrzej P. himself has connections with prosecutors conducting the investigation and head of the Vyszkowski D.A. erstwhile I asked him about it on the phone, he only replied, “I'm safe here with friends.” How is it possible that a female fleeing a violent husband can now face the threat of imprisonment for theft that was not actually there – which only confirms his friend the prosecutor from Wyszkow?
Andrzej P. does not gotta fear justice, due to the fact that he is personally friends with prosecutors and judges. Similarly, Grażyna W. of Podkarpacia, who avoided charges due to her connections. In a conflict with her ex-husband, she urged her lover to attest about alleged abuse by her ex-husband. Despite the apparent conflict of interest, the justice associated with Ms. Grażyna of the IRS has not resigned from ruling on the case.
The example of Magdalena C. from Warsaw clearly shows how this kind of dependence works. Her ex-husband was represented by a lawyer who had previously defended the justice in a individual case. Despite this, the justice has not decided to exclude herself from this case.
These examples illustrate the manipulation of justice. This phenomenon was frequently criticized by PO during the PiS era. Despite changing power, the strategy remained the same, but political loyalty changed. By October 2023, PiS-related people could number on protection from law enforcement, while opposition politicians were exposed to prosecution. After the change of power, this situation intensified, but the political direction reversed.
These events again show how corrupt the judicial strategy is. The prosecution is not a neutral institution, but a tool for political persecution. The courts besides follow the same path. All this shows the request for a thorough improvement of the judiciary system, in line with the "all won" principle.
