The Prosecutor's Office shall examine a study on the suspected crime committed by the spokespersons of Zbigniew Ziobry, which consists in the detention of the disciplinary files of the judges, reports ‘Gazeta Wyborcza’.
According to the information provided by “Gazeta Wyborcza”, the judges Grzegorz Kasicki from the Szczecin territory Court and Włodzimierz Brazewicz from the Gdańsk Court of Appeals submitted notices to the prosecution. Both judges are temporary disciplinary advocates appointed by Justice Minister Adam Bodnar. Minister Bodnar has been directing specified persons to conduct disciplinary matters towards circumstantial judges since the beginning of this year, allowing him to exclude those appointed by his predecessor.
According to the newspaper's report, the anticipation of appointing temporary spokespersons was made possible by the Minister through the provisions introduced by president Andrzej Duda in 2017, which aimed to support Zbigniew Ziobra.
"Bodnar uses these rules to marginalize the 3 main spokesmen of the judges appointed by Ziobra: Piotr Schab, Przemysław Radzik and Michał Lasota. They became celebrated for the prosecution of protesters against limiting the independency of the judiciary, and Ziobro rewarded them with promotions" – reads “GW”.
According to the reports of ‘Gazeta Wyborcza’, the actions of Minister Bodnar consequence in the deprivation of these ombudsmen of the chance to lead in over 60 cases. According to the newspaper, this concerns, among another things, the cases of judges who referred questions to the Court of Justice of the European Union, issued judgments on the basis of decisions of global tribunals and questioned the position of recently appointed judges whose appointments were approved by the politicised National Judicial Council.

Notification to the EPPO
Ziobrowski ombudsmen refuse to supply fresh ad hoc ombudsmen with papers concerning certain proceedings. Without these documents, the fresh spokespersons cannot take action.
Anna Adamiak, Advocate General, informed “Gazeta Wyborcza” that 2 ad hoc ombudsmen had filed a study to the Home Affairs Department of the National Prosecutor’s Office on the anticipation for the Disciplinary Ombudsman to commit a crime and 3 of its deputies.
The notifications concern a possible crime, which involves not providing papers from disciplinary proceedings despite the requested transmission, resulting in persons who are not entitled to have them hiding them.
The ad hoc Ombudsmans were not provided with papers from eleven proceedings despite their demands. The Prosecutor's Office has been informed of the anticipation of committing crimes, specified as overshooting of powers, obstructing access to information and concealing documents.
