Ministry of improvement and Technology recalls the key work of home and housing owners. No energy performance certificate may consequence in a fine of up to PLN 5000. This is simply a request that applies to most properties in Poland, but many owners inactive do not realize its importance.

What is an energy performance certificate?

The energy performance certificate shall be a paper indicating how much energy the building or residential premises usage during the year. This is key information for future buyers or tenants of real estate, who can so estimation future operating costs.

From April 28, 2023 having specified a paper has become compulsory for owners who plan to sale or rent their property. The absence of a certificate may be considered a breach of the rules, which threatens with financial penalties.

Who's the duty?

The provisions require that the energy performance certificate shall have:

  • all buildings and dwellings that are sold or rented after the entry into force of the fresh rules,
  • properties put into service after December 31, 2008which have not previously had specified a document,
  • public buildings where the useful area exceeds 250 m2 and are frequently visited by citizens.

It is worth noting that the owner of the building or flat is obliged to supply the certificate to the fresh tenant or buyer before the conclusion of the contract.

What are the penalties for deficiency of a certificate?

The Ministry of improvement and Technology points out that the deficiency of an energy performance certificate may consequence in a fine of even PLN 5000. The punishment shall be imposed in an administrative manner, which means that non-compliance may be detected in the course of regular checks or by a notification by the tenant or purchaser.

How to Get a Testimony?

The energy performance certificate may only be drawn up by a individual with the applicable qualifications entered in the registry kept by the Ministry of improvement and Technology. The cost of implementing specified a paper is usually from 300 to 600 zł, depending on the size and kind of property.

In drawing up the certificate, account shall be taken of factors specified as the thermal insulation of the building, heating systems, ventilation systems or energy sources. Building owners should pay peculiar attention to these aspects in order to avoid additional costs associated with improved energy performance.

Why is the witness important?

Having an energy performance certificate is not only a legal obligation, but besides an advantage for the property owner. This paper may:

  • increase the value of real property in the market,
  • identify the possible for energy savings, which is peculiarly crucial at expanding heating costs,
  • increase the attractiveness of the flat or home in the eyes of possible tenants or buyers.

Do not wait for inspection – check your duties

Although checks on the possession of an energy performance certificate are not yet common, it is worth to act in advance. Each owner should guarantee that its property meets legal requirements. The cost of the certificate is tiny compared to a fine of PLN 5000.

Also those planning to acquisition or rent property should pay attention to this document. The absence of a certificate may be a signal that the owner neglects another aspects of the property.
