MP KO Roman Giertych filed an electoral protest with the ultimate Court, demanding the annulment of the presidential election results. In its letter, it points to many irregularities, including "abuse of the law by setting up electoral committees that did not apply for President". The issue may be crucial for the final result of the vote.
Election protests go to the ultimate Court
By Wednesday (11 June 2025) the ultimate Court received 108 electoral protests. The Pato-Chamber of Extraordinary Control and Public Affairs SN already on Tuesday considered six of them, leaving them without further a run. The time limit for protesting is up. 16 June, which means that the number of applications may inactive increase.
IKNiSP – a court that is not a court
It has been stressed many times that "Judges" of the Extraordinary Control Chamber do not meet the standards of independency required by the Constitution and global law. The Court of Justice of the EU, in its judgement of 19 November 2019 (Case C-585/18, C-624/18 and C-625/18), made clear that KRS after the 2017 amendment does not warrant independency from the executive authoritywhich undermines the legality of its judges.
Also European Court of Human Rights (ECHR) judgement of 7 May 2021 (Xero Flor v. Poland) concluded that the composition of an SN with the engagement of “neas Judges” violates the right to a fair trial. Polish courts, including Supreme Court in the Chamber of Labour and Social Insurance (resolution of 23 January 2020, IPP 3/19), indicating that persons appointed by the fresh KRS are not judges within the meaning of the law.
SN spokesperson tries to defend political rooms serving Kaczyński: ‘Technical error’
Neossier Aleksander Stępkowski, SN spokesperson and associate of the illegal and politicized Extraordinary Control Chamber, in an interview with Onet admitted that the evidence was "Unfortunate", but resulted from the requirements of the IT system.
— "If there are respective cases in the same line-up at a secret sitting, 1 starting hr should be fixed and then the judges will recognise them 1 by one. Here akin times were entered due to the fact that the strategy required different hours. The exact time for each case could not be predicted’ – explains Stępkowski.
He besides added that "Electoral protests will not be considered without due care"And the full situation is just ‘communication error’.
The Ombudsman besides referred to the criticism of Prof. Wróbel:
— "Judge Sparrow should explain how he intends to identify 2 cases in the Criminal Chamber tomorrow, which has been designated for the same hour, in different halls" He summarized.
Election protests in the hands of people without a card
The fact that The importance of elections is decided by people without crucial nominations, is simply a serious threat to democracy. "Minute" examination of protests only confirms that IKNiSP treats them as formality, and not the actual verification of the legality of the vote. This is another example of how "pokemons" in togas – as it is called illegal pseudo-judges – work for political interestsNot the regulation of law.
Can their rulings be trusted?
In the light jurisprudence of the Court of Justice of the European Union, the Court of Justice of the European Union and the Polish courts themselves – no. Any IKNiSP decision, including in electoral matters, may be challenged as issued by an authority without independence. As long as there are members of the SN appointed in violation of the Constitution, no ruling will have full legal effect.
What's Roman Gierty charging?
In his protest, Gierty points to serious irregularities, including:
- Abuse of electoral law by setting up committees that have not submitted a presidential candidate.
- Potential forgerys results in certain electoral committees.
"If it turns out that most of these committees have utilized a brazen method of falsification by replacing the results of the candidates, it does not imagine that a request for conversion of all votes is not included. After all, falsifications could have been minor” – wrote MP KO on platform X.

Supreme Court decision – will there be a recalculation of votes?
Thursday (12 June 2025) The ultimate Court issued a communicationwhere he allowed the anticipation recalculation of votes In 13 regional electoral commissionswhere irregularities have been found. This decision may affect the final result of the election, especially if there is evidence of manipulation in another districts.
What's next for Gierty's protest?
The process of examining protests may take respective weeks. If the ultimate Court considers Gierty's argument to be reasonable, it may even come to cancellation of elections in certain districts. In utmost cases, this could lead to a repetition of the vote.
Is that a precedent?
In the past of Polish electoral law there have been cases of annulment of local elections, but at national level specified a situation would be unprecedented. It's worth reminding you Constitutional Court and global Institutions have repeatedly stressed the request to guarantee transparency of the electoral process.
