The fresh government will let the termination of the matrimony before the head of the civilian position office or consul, without the request to affect the court. This simplified divorce procedure will only be possible in certain cases. Key reasons are:
* Oh, yeah * No collective minors
* At least 1 year of marriage
* Complete and permanent distribution of life, confirmed by a consistent message by the spouses
* Polish citizenship of both spouses or residence in Poland in the absence of a common nationality
According to the draft, even if these conditions are met, the spouses will be able to choose a judicial way to divorce. The termination of the matrimony before the manager of the USC will require the full consent of the spouses as to both the will to divorce and the choice of out-of-court mode.
The planned procedure will be two-step – first, the spouses will submit a declaration of will before the head of the civilian position office (or consul in the event of their stay abroad), then the head of the office will join the matrimony certificate with a mention to the dissolution of the marriage, which formally ends the relation at the time of the declaration.
According to the assumptions, these activities can be carried out at any civilian position office in Poland, according to the rule of location. An out-of-court divorce may be annulled by a court in exceptional cases, e.g. in the event of a defect in the declaration of will or disclosure that, at the time of its expression, spouses had joint minors of children.
