Religious symbols can be placed on the desks of officials. Trzaskowski is under pressure!

After more than 2 months, Warsaw City Hall responded to a petition sent by thousands of citizens based on a model prepared by the Ordo Iuris Institute. In an authoritative letter, subordinate Rafał Trzaskowski states that “any individual working at the office has the right to place spiritual symbols on his desk.” The position is powerfully softened by the text of the order, which explicitly prohibited the placing of spiritual symbols “on walls, on desks”.

On 31 July in the morning hours of the Warsaw City Hall undetected its authoritative answer on its website (date of writing: 30 July 2024, sign: CKS-RT.152.5.2024.PRO) to a multiple petition of citizens on the repeal Order of the president of the Capital City of Warsaw No. 822/2024 of 8 May 2024. establishing in Warsaw offices ‘standards of equal treatment’. As it turned out, 1 of the “standards” imposed by this order is the ban on vulnerability The cross and spiritual symbolism: “No symbols related to a peculiar religion or religion are displayed in buildings of the office accessible to outsiders and during events organised by the office. The inhabitants of Warsaw and all of Poland have decided to protest against the act of local law so clearly acceptable to the rule of freedom of religion and its expression, as expressed in Article 53 of the Constitution of Poland, as well as grossly contrary to the case law of the ultimate Court and the European Court of Human Rights, as well as to resolutions of the Sejm and the Senate. To this end, the Ordo Iuris Institute has already prepared and made available to citizens on 17 May model complaint against the President's orderwhich any resident could fill, sign and send to the address of the City Hall. The civic petition was given number 28/2024.

Independent of the Ordo Iuris Institute, their interventions were not in favour of the order of Rafał Trzaskowski, and were submitted by the City Councillors of Warsaw – Michalin Szymborska (interpelation No 71 of 23 May 2024) Philip Frąkowiak (Interpretation No 96 of 6 June 2024) and Michalina Szymborska and Dariusz Figura (common Interpellation No 97 of 6 June 2024). However, the Interpreter of Kamila Gołębiowska (Interpellation No 162 of 5 July 2024). In his answer of 24 June to the No. 71 appeal, the president of Warsaw, who disagreed with the allegation of a violation of constitutionally protected freedom of conscience and religion, stated that, in his opinion, "standards supply protection of freedom of religion for those working in the Office who have spiritual symbols for individual use". On the another hand, in consequence of June 27 to the No. 96, Vice president Aldona Machnowska-Gora stated that “standards do not require the removal of spiritual symbols from the Office’s space. No removal/recapture action is planned’. In consequence to an interpellation of 97 on 27 June, the vice president stated that "standards are an interior paper and so do not require public consultation". In its answer of 29 July to Question 162, the Vice President, in turn, took the position that, in the order, “it is primarily housing facilities and residents in territory offices or office delegations. The gathering rooms of territory councils are not specified places. These are peculiar spaces and about how they are to look, decide the councillors of a given district, not the President.”

However, only in consequence to a petition prepared by the Ordo Iuris Institute on 30 July, the office clarified that "any individual working in the office has the right to usage spiritual symbols according to his beliefs, among others, to have spiritual symbols, e.g. in the form of a medallion, tattoo, armbands, and to place spiritual symbols on his desk." The first text of president Trzaskowski's order clearly states that spiritual symbols must not be displayed "e.g. on walls, on desks", and the only exception was the symbols "held by persons working in the office for individual use, e.g. in the form of medals, tattoos, armbands" and, after all, in terms of meaning the word "carryed" clearly does not include "position on the desk".

The letter of the office is so a breakthrough and evidence of a fundamental change in the explanation of the order by the office itself. The City Hall, however, states that it is inactive prohibited to "expose spiritual symbols in rooms intended to take charge of public administration offices, but besides in courts or gathering rooms of typical bodies" due to the fact that "it can be read as suggestive, and this violates the rule of spiritual impartiality of public authority". This is so not yet a complete triumph of constitutionally affirmed values—the freedom of religion and the Christian heritage of the Nation—over anti-religious regulations—the full "standard" should yet be repealed.

To this end, the Ordo Iuris Institute continues to encourage signing petitions on this matter, which has already been signed by about 70 1000 Poles and Poles. The action will proceed at least until another Ordo Iuris initiative is considered at the Warsaw Capital City Council. Citizens' draft resolution Against anti-religious order, announced on May 25. On July 5th this task has been deposited with the Council together with respective 1000 signatures of the inhabitants of Warsaw and, in accordance with Article 41a(3) Municipal Government Act, the Council is required to consider it "in the next session following the submission of the draft, but no later than 3 months after the date of submission of the draft". In addition, June 4th Institute also revealed, that the order was prepared on a fee by an external foundation, which received as much as PLN 129,910 from the town hall, immediately after the change of its name and statutes and joining the board of the erstwhile typical Rafał Trzaskowski for women.
