Prosecutor of the ICC requests the arrest of Israeli Prime Minister Benjamin Netanyahu

Prosecutor of the global Criminal Court of the Hague Karim Ahmad Khan has requested detention for the Prime Minister and the Israeli Defence Minister and Hamas leaders for committing war crimes in Palestine, Gaza. Benjamin Nentanjahu released an authoritative message in response.

The ICC prosecutor at the Hague Karim Ahmad Khan released a message on Monday announcing that he had filed a request to I the Preparatory Chamber of the global Criminal Court, on arrest warrant for Hamas leaders in the Gaza Strip, but besides for Israeli Prime Minister and National Defence Minister.

The lawyer said Yahya Sinwar (leader of the muslim opposition ‘Hamas’ in the Gaza Strip), Mohammed Diab Ibrahim Al-Marsi, more known as Deif (Chief Commander of the Al-Kassam Brigade) and Ismail Haniyeh (Chief of the Hamas Politburo) shall bear criminal work for the following war crimes and crimes against humanity committed in Israel and the State of Palestine in the Gaza Strip, at least from 7 October 2023:

  • extermination as a crime against humanity, contrary to Article 7(1)(b) of the Rome Statute;
  • murder as a crime against humanity, contrary to Article 7(1)(a) and as a war crime, contrary to Article 8(2)(c)(i);
  • taking hostages as a war crime contrary to Article 8(2)(c)(iii);
  • rape and another acts of sexual force as crimes against humanity contrary to Article 7(1)(g) and as war crimes within the meaning of Article 8(2)(e)(vi) in the context of captivity;
  • torture as a crime against humanity, contrary to Article 7 (1) (f), and as a war crime, contrary to Article 8 (2) (c) (i), in the context of captivity;
  • andWhereas these inhuman acts constitute a crime against humanity, contrary to Article 7 (1) (k), in the context of captivity; Cruel treatment as a war crime contrary to Article 8(2)(c)(i) in the context of captivity;
  • insulting individual dignity as a war crime, contrary to Article 8(2)(c)(ii), in the context of captivity.

My office claims that the war crimes accused in the motions were committed in the context of the global armed conflict between Israel and Palestine and the parallel non-international armed conflict between Israel and Hamas. We claim that the alleged crimes against humanity were part of a broad and systematic attack by Hamas and another armed groups on the civilian population of Israel, conducted in accordance with organizational policy. In our opinion, any of these crimes proceed to this day - ICC lawyer at The Hague Karim Ahmad Khan.

The prosecutor stated that Hamas leaders in the Gaza Strip had planned and instigated crimes on 7 October 2023 and through their own actions, including individual visits to the hostages shortly after the kidnapping, admitted their work for these crimes. The lawyer believes that without their actions these crimes could not be committed, hence they are charged both as accomplices and superiors. ICC besides argues that there are reasonable grounds to believe that the hostages taken from Israel were being held in inhumane conditions and that any were subjected to sexual violence, including rape, during imprisonment.

In an application for an arrest warrant for Prime Minister Benjamin Netanyau and Minister of Defence Yoav’a Gallanta prosecutor noted that Israeli politicians be liable for the following war crimes and crimes against humanity committed in the Gaza Strip at least from 8 October 2023:

  • the famine of civilians as a method of conducting war as a war crime contrary to Article 8(2)(b)(xxv) of the Statute;
  • intentionally causing large suffering or serious bodily or wellness harm contrary to Article 8(2)(a)(iii) or cruel treatment as a war crime contrary to Article 8(2)(c)(i);
  • intentional killing contrary to Article 8(2)(a)(i) or execution as a war crime contrary to Article 8(2)(c)(i);
  • intentionally directing attacks on civilians as a war crime contrary to Articles 8(2)(b)(i) or 8(2)(e)(i);
  • extermination and/or execution contrary to Article 7(1)(b) and Article 7(1)(a), including in the context of famine-related deaths as a crime against humanity;
  • persecution as a crime against humanity contrary to Article 7(1)(h);
  • other inhuman acts constitute crimes against humanity contrary to Article 7(1)(k).

My office claims that the war crimes alleged in the motions were committed in the context of the parallel global armed conflict between Israel and Palestine and the non-international armed conflict between Israel and Hamas (including another Palestinian armed groups). We claim that the alleged crimes against humanity have been committed as part of an extended and systematic attack on the Palestinian civilian population, in accordance with the state's policy. In our opinion, these crimes proceed to this day.

Response by the Prime Minister of Israel

Israeli Prime Minister Benjamin Netanyahu responded to the decision of the ICC prosecutor in The Hague. Politician proposal Karim Ahmad Khan called scandalous and disgraceful. He stated that the issuing of an arrest warrant on democratically elected Israeli leaders was “a moral outrage on a historical scale”. Netanjahu stated that Israel has waged a "fair war against Hamas" which has made the worst attack on Jews since the Holocaust. He found the charges of war crimes absurd. The Israeli Prime Minister besides stated that the ICC prosecutor refuses "Israel's primary right to self-defense".

Now, in the face of these horrors, Mr. Khan creates a warped and false moral balance between the leaders of Israel and Hamas supporters. It's like creating moral equality after 9/11 between president Bush and Osama bin Laden or during planet War II between FDR and Hitler.

Regardless of the slanders about the blood which Mr Khan has given, Israel will proceed to wage this war in full compliance with global law.
