Former First president of the ultimate Court of Margaret Gersdorf in an interview on Polsat News gives opinions on the Court of State for president Andrzej Duda and his successor, justice Małgorzata Manowska.

Professor Margaret Gersdorf, erstwhile First president of the ultimate Court, returned for a minute to public space due to an interview for Polsat News. Thus, the erstwhile president suggests that although the president could theoretically face the Court of State, this process would not have major consequences for Andrzej Duda, and its effects could be minimal.

Successor criticism

In an interview with Polsat News, prof. Gersdorf besides commented on the current First president of the ultimate Court, justice Margaret Manowska. Gersdorf did not avoid grades, noting that Manowska was a “good lawyer and a good judge”, however, she added that “she was allowed to check out the literate ideology.” It is worth reminding that Manowska took the position in 2020, becoming a key figure in the Polish judiciary under the United Right. Gersdorf recalls that as the First president of the SN, Manowska made any controversial decisions: “As I President, any circular resolutions are not so, reports have not reported, various things she should not have done, and she surely knew it well, due to the fact that it is simply a good lawyer and a good judge.”

Controversy around the neo-KRS and the Przyłębska Tribunal

In an interview, prof. Gersdorf besides raised issues related to the neoKRS and the Przyłębska Tribunal. The erstwhile president referred to the judges appointed in fresh years of the doubles who, in her opinion, should be removed from the ruling. In the context of the neo-KRS, she noted that this body was called up in a way incompatible with the constitution. She stressed: “If we say they are judges, they must be paid their wages. And if we say that they are not judges due to the fact that they were wrongly called, they can not be paid this salary."

Her assessment of the current situation in the Polish judiciary is clear – many neo-judges who broke constitutional rules should not execute their functions.
