New rules for the posting of judges. What does the bill introduce?

The Ministry of Justice stresses that the amendment aims to introduce transparent rules on the posting of judges.

"The amendment of the Act introduces transparent rules for the delegation by the Minister of Justice of a common court justice to execute judicial duties and besides regulates matters relating to the additions to the delegation" – read on the Ministry website.

Under the fresh rules, the posting of a justice to another court will only be possible if justified needsuch as:

  • heavy workload in court,

  • planned dismissals.

"When the justice is seconded, the Minister will gotta take into account the duration of the judicial service, the experience in examining certain categories of cases, the efficiency of the proceedings and the impact of the delegation on the functioning of the court in which the justice has previously served" – emphasizes the ministry.

It considers that the fresh rules will not improve transparency, but only enable Minister Bodnar introducing your people to key courts.

"Its aim is to replace the judges appointed by the president with judges associated with Minister Bodnar.
