In fresh days, the Polish media has provided information on the planned introduction of a taxation on home cakes and pastries, which would start to apply from 2025. This message sparked large controversy and sparked a wave of outrage among net users. Is there truly an extra taxation on our favourite cheesecake for Christmas? Where did the fresh taxation Information come from?
It all started with a mistranslated article from the German portal that dealt with changes in taxation laws in our western neighbours. The publication describes the modifications to VAT imposed on the sale of home pastries during school fairs in Germany. However, the problem was that this information was misinterpreted as a fresh EU directive that would apply in all associate States of the European Union, including Poland.
Mispretation and its Consequences
The alleged taxation on home cakes was widely publicised in the Polish media, which caused concern both among people who were baking for their own usage and among organizers of local events specified as school fairs or festivals. The media reported that the fresh regulations would apply as early as January 2025, which further fueled emotions.
However, lawyer Piotr Leonarski, who examined the substance in depth, rapidly explained that these reports were completely unfounded. On platform X (formerly Twitter), he wrote that there is no fresh EU directive on the taxation of home cakes. Misinformation came from the misunderstanding and incorrect translation of the German article, which referred only to local problems with the implementation of the EU VAT Directive by Germany.
What truly Happens in Germany?
The changes that took place in Germany afraid only the way the VAT Directive was implemented at local level. German schools, kindergartens and another public institutions, organising pastry fairs, will be required to deduct VAT on the sale of home pastries. Importantly, these provisions do not apply to baking prepared for individual usage at home, but only to those sold publically as part of specified events.

The current government does not supply for the taxation of baked cakes for individual usage or for local fairs. All the confusion was due solely to misinterpreting and spreading false information.
