The fresh government will deal with the politicized TVP. Changes this week

The closure or dismissal of companies may be presented as a restructuring process for public media.

Before the coming holidays, concrete steps are planned to accomplish fast and noticeable changes in the media sector. During the past weekend, intensive negotiations and precise details were held, according to information provided to the organization representatives forming the current ruling coalition.

This week, a political and legal plan is planned, which will initially focus on Polish Television, with a view to eliminating it. At the same time, talks are being held in government spheres on the approach to the National Media Council, as well as the preparation of fresh regulations covering the full public media sector.

At the same time, the Law and Justice organization (PiS) prepares to counterattack. During the Saturday gathering of the Political Council of the Law and Justice, a resolution was adopted expressing protest against the "destruction of public media".

There are 2 possible scenarios for changes of a legal nature. The first assumes the start of the liquidation process of Polish Television, Polish Radio and Polish Press Agency companies. This process envisages the exchange of their boards, which could consequence in further reorganisations. The liquidation procedure is not limited in time, which would let it to be maintained for respective years, which in turn would let for all essential changes, including personnel, in the state radio station, tv and the Polish Press Agency, even without interruption of broadcasting programs.

The second script assumes only the cancellation of the boards in accordance with the extraordinary procedure laid down in the Commercial Companies Code. This procedure shall be applied in the event of concerns regarding mismanagement of the company's assets. In both cases, representatives of the sole owner of public media, the Treasury, who in this case are government ministers under the leadership of Donald Tusk, play a key role.

An effort to intervene is unsuccessful

The Law and Justice organization (PiS) anticipated these plans and was not content with simply a political position. The Constitutional Court, which issued a decision on Thursday, theoretically having the possible to block government's actions towards the public media, launched the aid. However, it is worth noting that this provision has no legal force. Among the judges liable for this decision was Jarosław Wyrembak, who was wrongly elected. Moreover, this provision is binding only on the parties active in the proceedings. In the case of a request to the Constitutional Court by Members, these parties shall include the Sejm and the lawyer General. The State Treasury is not a organization to proceedings, and it is the owner of state-owned radio and tv companies.
