From April 1, 2025 all companies registered in National Court registry (CRS) by the end of 2024 they are obliged to usage the strategy e-Services. It is an electronic equivalent of conventional recommended shipments to improve communication between companies and public administration. Despite the impending deadline, only 11% Companies have so far established e-Service addresses, which raises serious concerns about the willingness of entrepreneurs to change ahead.
What are e-Services?
e-Service is simply a service that allows electronic transmission of correspondence with offices and another entities, replacing conventional recommended lists. This strategy ensures full confidentiality, integrity and assurance of the service of documents, which is crucial in authoritative communication. The introduction of e-Services aims not only to velocity up the circulation of papers but besides to reduce the costs of conventional correspondence.
Who's the duty?
From April 1, 2025 the work to have an e-Service address includes:
- Companies registered with the National Court Register until the end of 2024.
Newly registered entities in the National Court registry after 1 January 2025 are obliged to establish an e-Service address as shortly as they registry their activities.
How to set up an e-service address?
The process of setting up an e-Service address is comparatively simple and includes respective steps:
- Sending a request: Make an application with Entrepreneur's accounts on the platform Business.gov.pl. The paper can be signed electronically.
- Address activation: Upon application the address will be added to Electronic Address Databases (BAE).
- Box activation: The last step is to activate the email box; the instructions will be sent to the given email address.
Having an active address for e-Services, an entrepreneur may conduct electronic correspondence legally equivalent to conventional letters recommended for confirmation of receipt.
No penalties for failure to comply – is this an incentive to delay?
Although the deadline for the implementation of e-Services is approaching relentlessly, no financial penalties are presently provided for the deficiency of inception and activation of the e-Service box. This may explain why specified a low percent of companies (11%) have so far fulfilled this obligation. However, no sanctions do not imply no consequences. Companies that neglect to implement e-Services may encounter difficulties in communication with offices, which may lead to delays in handling administrative matters or problems with updating data in the KRS.
