The Sejm passed a controversial amendment to the Criminal Code which alters the definition of rape. From now on, the suspect will gotta prove that he did not commit the forbidden act. Confederate Members inform that the fresh law will lead to an avalanche of false accusations.
The amendment amends the existing definition of rape under the wording "wholeads to sexual abuse, unlawful danger or deceit is punishable by prison punishment" adding a fragment to it "or otherwise despite its deficiency of consent".
This change raises large legal uncertainty due to the fact that it violates the fundamental rule of criminal law, namely the presumption of innocence. The law assumes that from now on, the accused of rape must prove his innocence. It is so possible to accuse any person, and it will be the burden of proof.
A completely left-wing law to change the definition of rape reported by the left-wing club was, of course, supported by most of the PIS!

335 Members voted in favour, 44 opposed and 47 abstained. The amendment will now go to the Senate.
15 Confederate Members (three did not vote) and 3 Kukiz’15 (all) members voted against the amendment. Surprisingly, the majority of Members of the Law and Justice, who are claiming to be a "conservative" party, voted in favour of the changes. In PiS 94, Members supported the amendment, against only 26, abstained 47 and 22 did not vote.
According to Mr Kukiz’15, Mr Mark Jakubiak, the amendment is flawed due to the fact that it will be hard to prove to the individual wrongfully accused of rape that the "second individual wanted too".
