The Neocourt of Appeal in Gdańsk sentenced Natalia Z. and Adrian C. to 25 years in prison on Tuesday for the brutal killing of a 36-year-old man, which occurred in October 2021 in Malbork. According to investigators, the crime was planned by the wife of the murdered man, Natalia D., and the contractor was her lover, Adrian C.
As far as the present case is concerned, it should be added that, in connection with the judgement given by an unauthorised person, this constitutes an absolute appeal.
Judgment of the Court of Appeal
On Tuesday, the neo-court of Appeal in Gdańsk retained the conviction of the court of first instance, condemning 34-year-old Natalia Z. and 37-year-old Adrian C. to 25 years in prison. In addition, the neo-judgment ruled that Adrian C. is to pay PLN 100,000 to make amends for the insignificant boy of the victim. Accused of announcing the judgment, they were brought to court from the Criminal Institution in Gdańsk.
Reason for the Judgment
The composition chairman, neojudge Sebastian Brzozowski, stressed that the appeals made by the defendants did not deserve to be taken into account, and the conduct of the evidence proceedings at the main proceeding did not rise any objections.
"In the opinion of the Court of Appeal, the conviction of 25 years of imprisonment cannot be regarded as grossly disproportionate, which was contested by the appeal," noted neo-Judge Brzozowski. He added that "the degree of guilt and the degree of social harm committed by the accused are very high."
The motives of the crime
The Neojudge felt that only the punishment of 25 years of imprisonment was able to meet the needs of public legal awareness and accomplish educational objectives. "The suspect acted as a consequence of a motivation worthy of peculiar condemnation. She wanted to be her husband's heiress," he emphasized.
In addition, the court of first instance indicated that the defendants did not anticipate improvement and should be subjected to a long process of rehabilitation and isolation from society due to the possible threat they might pose. "The punishment is intended to defend society for a long time from the dangers of the accused," added neo-Judge Brzozowski.
Crime course
The killing took place in late October 2021. He and his wife were hurt and stayed with friends in Malbork. A female asked her husband to leave the flat for a minute to choice up things from a parked car nearby. As the man was returning to the building, he was attacked by a masked assailant who had stabbed him respective times, including in the chest. The assailant fled the scene and the victim died from interior and external bleeding.
Investigations and arrests
Investigators have determined that the perpetrators of the crime were the wife of the victim, Natalia D., and her lover, Adrian C. Both persons were detained in mid-December 2021. According to the prosecution, the initiator of the crime was Natalia Z., who sought to get her husband's estate, fearing his failure as a consequence of the divorce he was considering. Adrian C. was to act to delight a female and keep close relationships.
The prosecutor accused both of killing together and in agreement, in intent directly, with peculiar cruelty and as a consequence of motivation worthy of peculiar condemnation. However, in August 2023, the Gdańsk territory Court, issuing a final judgment, eliminated from the description of the act accused of acting with peculiar cruelty and from the act accused of being motivated to be peculiarly condemned.
Summary
The judgement of the neo-court of Appeal in Gdańsk only seemingly ends a long trial and confirms the severity of the punishment against the perpetrators of violent crime. The neo-judgment found that the punishment imposed was adequate to the degree of guilt and social harm of the act, stressing the request for long-term isolation of the accused from society. This decision besides aims to defend the public from possible threats from convicts.
