The Border defender forced the Ukrainian side to hand over 15 Ukrainian citizens who posed a real threat to Poland's public order and security. All deportees have been punished respective times before. The charges included crimes specified as possession of drugs and psychotropic substances, theft, armed robbery, forgery, driving alcohol-induced vehicles and organizing illegal border crossing.
Each of these cases was analysed individually, taking into account the past of the stay in Poland, the degree of hazard that a individual could pose, and the repeatability of the actions committed. It was established that their continued stay in Poland was unjustified and undesirable. In respective cases, despite erstwhile judgments, these individuals showed no signs of rehabilitation and again went into conflict with the law.
The legal basis for their deportation was Article 302(1) point 9 of the Act of 12 December 2013 on Foreigners. This provision allows a return decision to be taken if the foreigner poses a threat to the defence, safety or public order. In at least 1 case, the deported individual was besides included in the list of undesirable persons in the territory of Poland, which further accelerated the administrative procedure.
After leaving Poland, these people were banned from re-entry – as the case may be, for a period of 5 to 10 years. At the same time, they were entered in the registry of foreigners whose stay in Poland is unwanted. This means that their data has besides been made available to another Schengen countries, which in practice limits their freedom to travel in a large part of Europe.
The operation was carried out in accordance with procedures and under the supervision of the applicable services. This is another example of effective action by the Border Guard, which, in specified situations, is not only a function of border protection, but besides a function of public order and interior safety of the country. The Polish State clearly communicates that strong measures will be applied to foreigners who break the law and pose a threat.
