Two pardoned in violation of Article 32 of the Polish Constitution by Duda criminals from PiS Mariusz Kamiński and Maciej Wąsik, were high-ranking officials of the Ministry of Interior and Administration, informed that they would not attend the proceeding before the Pegasus committee. Their decision sparked a heated debate among politicians and public opinion. We remind you that Zbigniew Ziobro had a akin position as 2 pardoned criminals. However, this position was not shared by the court which, in view of its persistent avoidance, authorised its detention and the proceeding of the committee.

Pegasus Commission in the heat of criticism

On Tuesday, a proceeding was scheduled for erstwhile Minister Mariusz Kamiński and erstwhile Deputy Minister Maciej Wąsik. However, both politicians in their statements reported that they would not appear in front of the committee. They argue that the committee is acting illegally, citing the judgement of the Constitutional Court.

Maciej Wąsik wrote in his message on platform X:
"I declare that I will not be on call for today's Pegasus «Commission» hearing. According to the Constitutional Court's ruling, the “Commission” is acting illegally, which relieves me of my work to appear. At the same time, I believe that the work of the “commission” and the attitude of its members undermine the dignity of the Polish Sejm. The consequence of its activity is paralysis of the operational work of Polish peculiar services. The real nonsubjective is to guarantee impunity for certain politicians who commit serious corruption offences."

The mustache besides added that it did not intend to participate in the “masquerade”.

Mariusz Kamiński, who stressed in his statement:
"I refuse to attend the gathering of the alleged Pegasus Investigative Commission on 4 March 2025. The Constitutional Court ruling of 10 September 2024 makes it clear that this “committee” is acting illegally under the conditions of a constitutional tribunal. I submitted a letter to Szymon Holownia informing about my decision, calling on him to reconstruct his dignity in the Polish parliament as shortly as possible and take care of the political principles.”

Consequences of refusal

In consequence to the failure of Maciej Wąsik to appear before the committee, its members unanimously voted on a motion to impose a maximum punishment of PLN 3 000 on him. A fresh deadline was besides set for the proceeding of the MEP. In the case of Mr Kamiński, whose proceeding is scheduled for 12.30, the committee will most likely make a akin decision.

Is the committee legal?

The dispute over the legality of the Pegasus committee's activities dates back to September 2024, erstwhile the illegal Constitutional Court, in the composition of written politicians, issued a legally flawed ruling, indicating irregularities in its appointment and functioning. It is this decision that Kamiński and Wąsik mention to, arguing their decision on non-promotion.

What about the committee's work?

Refusal to present 2 key witnesses may importantly affect the committee's further work. Not only does this hold the investigation, but it besides undermines the credibility of the full process. Doubts about the legality of the committee's actions may consequence in further legal and political disputes.

Summary

The decision by Mr Kamiński and Mr Wąsik on non-internship before the Pegasus committee sparked another chapter in the political dispute over the legality of the actions of this body. The consequences of their decisions can be far-reaching, both for the politicians themselves and for the further work of the committee. Can we find a solution to this stalemate? Time will tell.
