On Thursday, the ultimate Administrative Court decided to deprive justice Tomasz Szmydt of immunity, who fled to Belarus and is suspected of spying. On that day, the disciplinary court of the ultimate Administrative Court agreed to bring the WSA justice in Warsaw, Tomasz Szmydt, to criminal liability. The NSA besides accepted the application for authorisation of his detention and temporary detention and suspended him in his duties. Bodnar has announced the release of an APB after Szmydt.
The allegations of espionage against justice Szmydt were brought forward by the prosecution. The request for immunity was submitted by the National Prosecutor's Office to the disciplinary court of the NSA. The Minister of Justice, Adam Bodnar, informed that the prosecution had besides requested approval to detain and temporarily detain a WSA justice in Warsaw, Szmydt.
A message from the National Prosecutor's Office, Prosecutor of Przemysław Nowak, revealed that an investigation was initiated on Wednesday of Tomasz Szmydt's engagement in abroad intelligence activities in Poland and Belarus. The prosecution is based on Article 130, par. 2 of the Criminal Code, concerning the provision of information to abroad intelligence which may harm the Republic of Poland.
The investigation was initiated ex officio after reports of political asylum that Szmydt made in Belarus. Its aim is to establish all the circumstances relating to possible cooperation with abroad intelligence, including the scope of the information provided and to analyse the property, individual and professional situation of the suspect. Prosecutor from the Mazovia Department of the Department for Organized Crime and Corruption in Warsaw conducts the investigation, and the operations are entrusted to the interior safety Agency.
Is the issuing of an APB changing the legal situation of the judge
No! No! Until he is present in Belarus or Russia, the practically initiated investigation with Article 130 par. 2 k. and the BOLO issued for him will not give him the chance to be held liable.
He will surely receive political asylum in Belarus, which he requested.
Therefore, the Belarusian authorities, even if we reached for legal aid – due to the fact that we have an agreement with Belarus on assistance in criminal matters – will not, of course, issue it.
Thus, it must be said with all firmness that the legal steps of the Polish state were exhausted at this point in time in order to put the justice in charge of not talking about the conviction.
