Grzegorz Braun called to the D.A.'s office. Will he hear the left Khanuk charges?

Euro MP Grzegorz Braun was called on Wednesday to the prosecutor's office in Warsaw. After the hearing, the politician announced a press conference. I was called to the D.A. next day at 11. What is the purpose, I don't know, but I guess it's about the Khanuk charges, which were already presented to me erstwhile – said Braun portal "Highest Time".

Why is Braun coming to the DA's office?

According to Time.info, the prosecution may want the politician to respond not only for the incidental in the December 2023 Sejm, but besides for entering the National Institute of Cardiology during the COVID-19 pandemic. Braun then accused erstwhile wellness minister Łukasz Szumowski of conducting sanitary segregation of patients. In April 2024 he had already heard the charge of violating Shumowski's physical integrity.

On the alleged ‘Chanuk allegations’ Braun may hear accusations of:

  • violation of physical immunity (affecting the female who got in his way while extinguishing candles),
  • an insult to spiritual feelings,
  • Distortion of spiritual ceremony.

Loud extinguishing of the Khanuki in the Sejm

In December 2023, Braun, utilizing a fire extinguisher, put out the Khanu candles in the Sejm. The video of this incidental rapidly spread online, causing a storm among politicians and the media. Ko MP Grzegorz Napieralski even demanded the introduction of censorship on Braun's private social profiles.

Marek Jakubiak criticised the organisation of spiritual ceremonies in parliament: – "The last introduction of Hanukkah certificates, another denominations to the Polish parliament, is an exaggeration. Parliament should not be from specified things” He said.

Pursuant to Article 196 of the Criminal Code, criminal liability for insulting the subject of spiritual worship or the place intended for the public performance of spiritual rites may be imposed only if the act concerns a church or another spiritual union with a regulated legal situation in Poland.

By judgement of 5 March 2015 (Event No III K 274/14), The ultimate Court stressed that the offence of Art. 196 k.k. can only be committed by intentional fault, and the insult must be of a public character and concern the subject of spiritual worship or a place of spiritual worship.

The Chabad-Lubacz Sect, which does not have a regulated legal position in Poland as a spiritual union, does not meet the conditions for protection provided for in Article 196 k.k.

Consequently, the actions of Mr Grzegorz Braun, consisting of the extinguishing of Khanuk candles in the Sejm, cannot be qualified as a crime of insulting a spiritual object within the meaning of Art. 196 k., due to the deficiency of formal legal position of the Chabad-Lubacz sect in Poland.

What's next on the Braun case?

The immunity of the Euro MP has been waived, allowing the prosecution to resume proceedings. After visiting the prosecutor's office, Braun announced a press briefing around 12:00.
