Why are June pensions besides low?
The problem of June pensions is due to the mechanics utilized by the Social Insurance Institution (ZUS). Persons who retired in June 2009-2019 received benefits calculated in a way that did not include full amounts of valorisation. As a result, their pensions were lower than they should have been.
The fresh bill, tabled by Members of Law and Justice, aims to remedy this error. According to the proposal, pensioners will be able to recalculate their benefits, which will translate into higher monthly payments and one-off compensation.
How much will rise and settle?
According to estimates, any pensioner who benefits from the fresh regulations can receive a one-off compensation of about PLN 14.8 thousand. In addition, the monthly pension will increase by PLN 160 on average. This is simply a crucial improvement in the financial situation for many seniors.
The cost of the improvement is estimated at PLN 1.4 billion and the yearly burden on the Social Insurance Fund will increase by PLN 183 million.
How do we apply the fresh rules?
The application for recalculation of the pension may be submitted within 6 months of the entry into force of the Act. ZUS recommends that injured pensioners lodge a complaint under Article 145a of the Code of Administrative Procedure. The letter must state that the basis of the application is the Constitutional Court judgement of 4 June 2024.
Unfortunately, due to the deficiency of publication of the judgement in the diary of Laws, the Social safety Office presently has no legal basis to act. In practice, this means that the first decisions will be refused. However, any decision shall be appealed to the general court.
Judgment of the Constitutional Court
The Constitutional Tribunal, in its judgement of 4 June 2024, stressed that the June pensions issue requires urgent legal regulation. Unfortunately, Prime Minister Donald Tusk did not print the verdict, which prevents its execution. This is another component that affects the hard legal situation of the retired.
What can we do to recover the lost funds?
ZUS recommends that pensioners submit complaints or requests for recalculation of benefits. In the letter, it must be made clear that the judgement of the Constitutional Court is the basis of the application. Although the first decisions will be rejected, it is worth referring to the common court.
