Maciej Duszczyk's next statements show that my concerns about the intent of his presence in the government were correct. It was to be the "element of humanitarianism", which Donald Tusk spoke of in his exposé – a fig leaf covering brutality in the task of safety of Polish borders. Now it is known that he will not cover it as much as he explained.
Two days after human rights organizations deployed petition to Prime Minister Donald Tusk to cease exportsMr Maciej Duszczyk, Deputy Minister for the Ministry of the Interior, interviewed Agnieszka Lichnerovich. He repeated the word “security” repeatedly, but I do not think that we can feel safe as long as migration policy is simply a hostage to populist slogans.
What did we hear in the conversation? “The wall of course remains, the wall needs to be strengthened”, “it is not known who the migrants are”, “the migration way through Belarus is not natural”, “we will not accept any migrants from the migration pact”, and the best quotes from Deputy Minister Duszczyk: “Well, if the courts decide that Poland cannot defend its borders, I cannot realize it.” Let us take a closer look at these quotations.
"The wall of course stays, the wall needs to be strengthened". Maciej Duszczyk has already explained that the wall is not effective, due to the fact that it stands besides close to the border line and Belarusian services can aid migrants cross it. If individual hoped that even a concertina would vanish from the border, which cripples and kills people and animals, hidden in bushes, and even in sitov and underwater – he would be disappointed. Concertin coils they remain, but after meetings with naturalists, they are to be additionally surrounded by nets, so that animals do not fall straight into it.
The perimetric strategy is besides to be expanded. Perimeter, or motion sensor system, allows you to track and halt people who have crossed the border, but besides inform about those who approach and deter them. "Migrants leave at the sight of the guards," said Prof. Duszczyk, who thinks it is simply a very good solution due to the fact that "it is not known who migrants are."
Which is actually true. As the border crossings are closed, even people blown up by Belarusian services in the forest and seeking a legal point of crossing the border cannot usage it. And I'm certain migrants would like to be able to walk across the border if they could just give them a chance. Unfortunately, legal transitions are closed, and even if they were open, migrants' passports are insufficient.
It is besides amazing that the individual afraid with migration policy speaks about the fear that Polish officers are causing. I was hoping that with the change of power there would be a turn in the approach to uniformed services. Since 2021, officers have held a circumstantial human rights violation training on the Polish-Belarusian border, ‘Afganistan’, As Jacek Siewara, head of the National safety Bureau, said, and besides training out of heartlessness – utilizing transports, humiliating people, laughing erstwhile migrants get entangled in wire coils, passing through fences, separating families, organizing hunting, ignoring the lives and wellness of people who are on Polish soil, and who are legally entitled to protection.
The same services after training return to work in Gorzów, Grodzisk or Poznań and what do you think they will forget what they learned at the border erstwhile they hit the streets of their own cities? most likely not. Or are you hoping for a milder treatment from a racist premise and a good look?
Of course, if we don't accept conclusions, we don't know who's coming to us. But does that give us the right to believe that these people are threatening the safety of the state? Prof. Duszczyk seems to think he did, and we so have the right to defend ourselves against them in all ways. It besides seems to virtually interpret the "border threat" as a threat to border infrastructure. Destroying it, according to the professor, may justify exports as indicated by Article 33(1) of the 1951 Geneva Convention.
Lawyer Marta Górczyńska, however, draws attention, that as long as exports are practiced, we are incapable to find whether, in the case of a peculiar person, the rule of non-refoulement, that is, the ban on returning a individual to a dangerous country, and as specified it must be considered Belarus, can be suspended due to the fact that we do not know whether it truly poses a threat to you.
I was very disappointed to hear the conversation present @MaciekDuszczyk ed Lichnerovich in @Radio_TOK_FM. The vice minister’s statements include a duplication of the incorrect legal position at the border. Short thread below https://t.co/mIjpkxAt6M

At Agnieszka Lichnerowicz's question about what will happen if the courts regulation illegal exports and it falls on the fresh government's credit, Maciej Duszczyk replied: "Well, if the courts decide that Poland cannot defend its own borders, I cannot realize it." Means the safety of Polish borders does not mean safety within Polish borders. We're very humane, but you better stay distant from us. Don't provoke me.
When will the transport end?
How long does the Deputy Minister let exports? Until the migration way which the Deputy Minister considers to be ‘unnatural’ closes. I wonder what way prof. Duszczyk considers "natural" erstwhile we live in a globalized world, fly airplanes and proceed to trade even with countries that are incapable to issue an effective passport to their citizens. The ‘unnaturality’ of this way is akin to the ‘unnaturality’ of the fact that migrants may have branded clothes, suitcases on wheels or good phones. I realize that "natural migration" is the kind erstwhile a man walks barefoot and barefoot on foot.
Of course, the way popularized Lukashenko, selling visas and lying that it was adequate to pass through the forest to be found in Germany, but this way besides existed earlier and could not be easy closed. Especially that – let us agree – politicians will not care about it at all now.
The migration pact is not to enter into force until 2027. Donald Tusk, as quoted by Maciej Duszczyk, promised that Poland would not accept a single migrant as part of the relocation. Our strongest arguments are war in Ukraine and exile from there and the force on the Polish-Belarusian border. So in the pact negotiations, force on the border even serves us. possibly that is why economical force and another sanctions against the Belarusian government are inactive lacking? possibly that's why there's inactive no point in asking for asylum, with a visa, with a justification.
"The case law of the national courts, the recommendations of the Commissioner for Human Rights of the Council of Europe, Dunji Mijatović, and the UN peculiar Rapporteur on Human Rights, Felipe González Morales, as well as the repeated statements of the Ombudsman point to the contradiction of the above regulations [exports — ed.] with national, EU and global law, [...] They besides violate the constitutional warrant of access to the procedure of applying for global protection in Poland and procedural guarantees concerning administrative proceedings" - they compose in an appeal to Prime Minister Donald Tusk humanitarian organizations.
The answer for now is as populist as the election campaign, in which migration threatened PiS, but besides threatened KO. There is no another thought for migration than to usage it for current interior and intra-EU policies. Unfortunately, with prof. Duszczyk taking office, there was no change, even at the level of the language spoken about migration.
Rule of Law Terror
Perhaps it is worth seeing this issue in the context of the current policy. An tremendous electoral force has proved to be the environment demanding change and return of the regulation of law, namely women's and human rights organisations. And it is precisely the demands of these environments that are inactive not met. Still, in order to enjoy full human rights, you should be a white man in Poland. Neither women, especially those of childbearing age, nor people of blue skin or non-Polish cultural origin can be certain that their safety, right to life and wellness or economical safety will be protected by the state.
Their rights become hostages of another serious electoral group – cynical Poles, electorate, which can depart from the PiS, and which is conservative, alternatively xenophobic, exposed to anti-immigrant propaganda and the content of the Church and oblast organizations specified as Ordo Iuris.
In the event of probable earlier elections, in the case of attempts to paralyze power by the PiS and president Duda, could failure to meet human rights expectations be useful to the Coalition on October 15? I'm afraid politicians can think that way. It's a privilege game. The stake was suspended not economical promises or settlement of abuse of power towards the institutions, but the rights of the most susceptible groups. It's reminiscent. ballad of Wojciech Młynarski about 2 horsesOne of whom was obedient and the another was not, but he received the whip, in fear of the 1 whose driver in fact feared more:
"This driver took his whip,
He took him in both hands.
And a good horse he washed.
And to the rude he utilized to say,
Dressing your voice to a harsh tone:
If you stand up, you bastard,
Then you'll get hurt just like him!’
