“Out with the Eurocommun”! Braun surprises with the consequence in the alleged 2025 presidential election

Sunday, May 18, 2025, Poles went to urn to elect a fresh president. According to an exit poll conducted by Ipsos for TVP, TVN and Polsat, Grzegorz Braun, a candidate of the Confederation of the Polish Crown, won 6.2% of the vote, placing fourth. This is simply a higher score than previously predicted, which gave him about 2% of the support.

Braun's staff was euphoria. The candidate himself stressed the importance of this consequence as “measure and weigh ahead”, announcing the continuation of political action.

"It was measuring and weighing before the fight, which a wide fire-extinguishing front would successfully emergence to the upcoming parliamentary elections."

Braun thanked his colleagues, including Vladimir Skalik, Roman Fritz, Jan Krysiak and Marcie Czech, for their engagement in the campaign.


Election program by Grzegorz Braun

Grzegorz Braun presents a program based on the slogans of sovereignty, tradition and economical freedom. Its main demands include:

  • National sovereignty: Braun advocates Poland's prepared exit from the European Union (Polexit) and opposes EU regulations which, in his opinion, harm Polish interests.
  • Foreign policy: It calls for a multi-directional abroad policy, based on the interest of Poland, with the anticipation of cooperation with different countries, including BRICS and EFTA.
  • Economy: Proposes the elimination of PIT, CIT and compulsory ZUS taxes, as well as deregulation of the economy and support for Polish agriculture without EU subsidies.
  • Education: He wants to introduce an educational voucher, giving parents the freedom to choose schools and teachers for their children, and destruct the teacher Card. and)
  • National security: Braun stresses the request to rebuild the Polish arms manufacture and make a modern army, while opposing Poland's participation in external conflicts.
  • Protection of conventional values: It advocates a complete ban on abortion, a restoration of the death punishment and a ban on promoting progressive ideas in public space.

Future prospects

Although Grzegorz Braun did not decision on to the second circular of presidential elections, his consequence may show increasing support for anti-system groups in Poland. The candidate himself announces further political activity and preparations for the upcoming parliamentary elections.

"Because this is my last speech on this campaign, due to the fact that we are already starting the next 1 tomorrow, so I will, on trial, repeat 3 Braun, who was my electoral program in the pill – and you know what? It will be my election program in a nutshell, due to the fact that this program will not grow old: go distant with the commune, go distant with the eurocomuna, go distant with the judaic people, live Poland.”

Summary:

In this case, it should be stressed that the presidential elections disagree importantly from the parliamentary elections, both in terms of procedure and legal effects. 1 of the key differences is the deficiency of a presumption of validity of presidential elections, which, unlike parliamentary elections, must be approved by the ultimate Court (Article 129(1) of the Constitution of the Republic of Poland).

In accordance with Article 129(1) of the Constitution of the Republic of Poland:
“The validity of the president of the Republic’s election is stated by the ultimate Court.”

This work is presently being exercised by the Chamber of Extraordinary Control and Public Affairs of the ultimate Court. In view of the case-law of the Court of Justice of the European Union (e.g. Case C-585/18, C-624/18 and C-625/18) and of the European Court of Human Rights (e.g. Case C-585/18), and of the European Court of Human Rights (e.g. Case C-585/18), Reczkowicz p. Poland, complaint No 43447/19), it is indicated that this Chamber does not meet the standards of an independent and impartial court established by the Act. It includes persons appointed with gross violations of the regulation of law and constitutional procedures, including the engagement of a body called "neo-KRS", whose legality has been undermined by many judgments of national and global courts.

Therefore, regardless of the result of the second circular of the presidential election – regardless of whether candidate A or candidate B win – a major legal problem arises. The question of the legality of the body liable for the determination of the validity of the elections may lead to a situation where the ruling of the ultimate Court is not deemed to have been given by a court established in accordance with the law. Consequently, this may prevent the elected president from taking office effectively, as Article 130 of the Constitution of the Republic of Poland states that the president shall take office after taking his oath to the National Assembly, which requires prior determination of the validity of the election.

Such a situation could lead to serious constitutional chaos and destabilisation of state bodies. In utmost cases, it can be utilized by policy makers to introduce extraordinary constitutional measures specified as emergency or even martial law (based on Articles 229 to 234 of the Constitution of the Republic of Poland), which poses a serious hazard to the legal order and democratic strategy of the state.
