The night work allowance shall be determined on the basis of the minimum wage, the change of which automatically results in a higher allowance being charged. Since it is calculated on the basis of the working time in the period in which work took place at night, 2 heights of this supplement will frequently be utilized for night work at the turn of months.

For working in a night work facility (which is specified by the employer in the working regulations or information on the conditions of employment – an additional 8 hours between 21:00 and 7:00) may be paid. It amounts to 20 % of the hourly rate resulting from the minimum wage for the night work (the amount of the allowance does not affect the basic wage of the worker). However, more favourable rules may be laid down in the interior rules applicable to the employer concerned.

Since the allowance is affected by the minimum wage and the working time in a given month, it varies from period to month, which is related to different working time dimensions, but besides to a double change in the minimum wage in 2024.

Important: The allowance shall be payable for the night work specified in the interior rules. It is due for any time worked at night – both planned and commissioned additionally (depending on the accounting of overtime), regardless of its length.

Example: The worker had a scheduled occupation 1 day in January 2024 by 10 p.m. Due to the late replacement, he remained in work for 30 minutes, which was already due to nighttime (according to the working regulations it starts at 22:00).

The night work allowance should be paid for each time worked during the night. In the case of incomplete hours, it should be determined proportionately. The worker should receive PLN 2.53 for this.

In addition to the addition of night work, the individual acquired the right to compensation for overtime arising in this situation. He is entitled to a wage and 100 % allowance or free time at his request (at 30 minutes) or without an application (at 45 minutes).

Working at night at the turn of months

The night work allowance shall be based on the working time in the calendar period in which the night work took place. This frequently results in the request to set 2 levels of allowances for night shift work at the turn of calendar months. We cannot calculate the dimension of the allowance in the period of the beginning of the change – we do not account for it on the basis of the concept of working day (24 hours from the start of work according to the working time agenda in force).

Example:The worker works at night at the turn of April and May – from 22:00 to 6:00, which corresponds to the night work facility. The supplement for 2 nights worked in April (22:00–24:00) is PLN 10.10 (2 x PLN 5.05) and for 6 hours working at night ranging from 0:00 to 6:00 1 May – PLN 31.80 (6 x PLN 5.30).

In 2024 it should besides be remembered that the minimum wage has changed in July, which results in the request to adopt a different basis for calculating the work allowance from the beginning of July (in peculiar from 0:00 on 1 July).
