The Treaty on European Union states that 1 of the fundamental values on which the EU is based is democracy. erstwhile the Treaty was adopted in 1993, the meaning of the word was clear: democracy is simply a strategy of a state that assumes the participation of citizens in the exercise of power, including by taking part in free elections and referendums.
In the last decade, there has been semantic satiation against the word “democracy” – opposition (no substance who it is at the moment) repeats the slogans “breaking democracy” or “restore democracy”. Now this word is utilized only instrumentally.
Over the past year, many presidential and parliamentary elections have been held in Europe. In Russia, Georgia and Belarus, the winners received strong voter support. In Moldova, pro-EU Maia Sandu won in the second circular only thanks to the support of the diaspora surviving for many years outside her homeland. In France, in the elections to the European Parliament, the right-wing National Union, led by Marine Le Pen, won over 31% of the support – twice as much as the second camp, associated with Emmanuel Macron. These results were a informing to EU pro-democratic structures that power could be allowed by individual like Viktor Orbán in another EU country.
In November 2024, the first circular of presidential elections in Romania was held, which was won by a candidate outside the two-party deal, Călin Georgescu. The Romanian Constitutional Court first acknowledged its outcome, and a fewer days later (after exceeding the deadline for submitting complaints) decided to “return the full presidential election process”. According to the judges, the election consequence was due to organized manipulation carried out from Russia. However, they were incapable to supply any evidence of 3rd country interference in the electoral process. The conviction was based solely on a study by the ultimate National safety Council, headed by the President. The study reads that Georgescu's only charge is to increase the visibility of social media. According to political scientist Piotr Oleks, this good consequence is primarily due to the fact that the Romanian society is tired of the invasion of the political scene by 2 parties. Nevertheless, the European Union agrees with the form of democracy represented by the Romanian Constitutional Court.
Another example of the Western European knowing of democracy is the conviction of Marine Le Pen for embezzlement of European Union funds. The Paris court sentenced her to 4 years of imprisonment, a fine and, worse still, a ban on seeking political office for 5 years. According to the president of the Court of Justice, Bénédicte de Perthuis, Le Pen's actions were "a serious and lasting attack on the principles of democratic life in Europe". The problem is that Le Pen (employment of organization workers as parliamentary assistants and paying them from European Union funds) is rather common in the EU and is not a problem for another "democratic" groups. The conviction passed on March 30 this year has not yet completely closed the door to the Elysée Palace of the favourite in the 2027 presidential election, as it is not valid.
In the United States, the consequence of the elections did not appeal to pro-EU politicians either. The election of the Republican (and not democratic) president and his actions opened his eyes to leftist European parties – Donald Trump showed that the US would not be allowed to usage the European Union in terms of both arms and economy. The administration of the fresh president supported the alternate for Germany, opposing at the same time the judgments that fell in France and Romania.
The above decisions of the courts can only strengthen the belief that the State has been seized and that there is something incorrect with democracy within the meaning of the European Union. In both Romania and France, the same process can be seen: candidates outside the agreement gain an advantage, so democracy should be reduced by prohibiting them from participating in elections (the March ruling of the court of Călin Georgescu does not let Călin Georgescu to participate in the election reassumption). In Poland, there has not yet been specified a regulation of freedom. However, given the increasing score in the polls of Sławomir Mentzen, it is not excluded that the "free courts" will find a paragraph and on it.
