CBA agents detained Peter M. and Anna P. in Warsaw on Wednesday 23 September at the command of the Regional Prosecutor's Office in Rzeszów. Both of them are transported to trial activities, and the investigation concerns irregularities in the Polish National Foundation. There are no charges at this stage, so there is simply a presumption of innocence.
Detention in Warsaw
Jacek Dobrzyński, Minister of peculiar Services Coordinator, informed about the activities of the services. Officers of the Central Anti-corruption Office detained Peter M. and Anna P. this morning, after which their transport to the Regional Prosecutor's Office in Rzeszów began. This unit conducts proceedings concerning irregularities in the Polish National Foundation.
The message is sparing for now. It has not been disclosed in what capacity the detainees are to be questioned, what activities the prosecution has planned, or whether charges will be brought against them. Just stopping doesn't make you guilty. Each of these individuals benefits from the presumption of innocence.
Investigation of the ‘Justice Courts’ campaign
The Rzeszow D.A. conducts a wider investigation into the activities of the PFN. In July, the CBA detained 2 erstwhile members of the Foundation's authorities. As shown by Official communication of the Regional Prosecutor's Office in Rzeszów, investigators accused them of abuse of their powers and of failing to fulfil their duties in connection with the financing of the 2017 Fair Courts campaign.
According to the prosecutor's office, the Foundation was to endure harm of at least PLN 8 428 542,74. Investigators argue that the run was contrary to the statutory objectives of the PFN, and its value was a political marketing service for Law and Justice and Solidarne Poland. Suspects did not admit to the alleged act and gave explanations. Details July's allegations against the erstwhile PWN authorities were described separately.
Today, there is no reason to automatically attribute charges made in July to Peter M. and Annie P. However, today's detention shows that the proceedings have not been closed and include further activities. The work of individual persons must be determined by the prosecution, and only the court can decide on the fault.
Public money requires full settlement
The Polish National Foundation was to advance Poland and defend its good name. An institution with specified an nonsubjective must be peculiarly resistant to organization interests and opaque financial decisions. all gold issued under the national name requires clear justification, due to the fact that the credibility of the state and the trust of Poles are at stake.
The investigation should be carried out smoothly, without political theatre and without judgments issued in the media before the proceedings are concluded. If there has been abuse, the liable must endure the consequences. If suspicions do not find confirmation, the public should besides get clear information. The interest of the state requires truth, not selective settlement of opponents or protection of their own camp.
The prosecution is to disclose further decisions
The nearest communications should clarify the procedural position of detainees, possible allegations and decisions on preventive measures. Until then, it is possible to describe the confirmed actions of the CBA, but not to present suspicions as proven acts.
The case of the PFN concerns money allocated to the Polish state right and the image of the country. Poles have the right to know whether these measures were issued in accordance with the law and statutes of the Foundation. The State is required to answer this question quickly, reliably and to the end.
