On the websites of the Government Legislative Centre, just before the coming weekend, a draft amendment of the laws was published, the aim of which is to soften the rules and facilitate business activity. This is another step in the implementation of government promises to improve conditions for entrepreneurs. Moreover, most of the proposed changes are to enter into force as early as 1 January 2025.
Another affirmative change for entrepreneurs: deregulation getting closer
The government had already announced that it would be easier to conduct business, and now there is simply a draft of fresh regulations. What can entrepreneurs expect? In the field of administration and simplification of bureaucracy, 1 can expect, inter alia, to remove the request to present the papers of the prosecution or the power of lawyer to the office if specified authorisation is documented in public registers. In addition, further steps are planned towards deregulation of stamps and seals.
Many changes besides concern checks and penalties for entrepreneurs. The maximum control time of micro-entrepreneurs is expected to be reduced from 12 to 6 working days. The frequency of checks is to be adapted to the assessed hazard associated with the business activity, which means that the little risk, the little control. In addition, before control, the entrepreneur will receive a list of information and papers that the control authority will want to review, which will let for better preparation for control and avoid unpleasant surprises.
Following the changes, it will be possible to rise objections to the control activities (although not stopping these activities) erstwhile the authority carries out the inspection in an unauthorised manner, citing exceptions to the control of economical activities. The government besides plans to prevent the abuse of criminal proceedings or taxation offences in order only to suspend the limitation period for taxation obligations.
It is besides crucial that the amendments will enable the alleged "soft calls" to be spread and enable the authorities to pay administrative penalties and late fees straight ex officio.
Other changes planned by the government
Undoubtedly, changes in company control will be crucial for most entrepreneurs. However, the government besides intends to regulate issues related to the conduct of undeclared business by foreigners and the covering of civilian contracts under specified activity. It is besides planned to modify the definition of tiny and micro-installations in the Renewable Energy Act.
Most of these changes are to be introduced comparatively rapidly – the government wants this to happen as early as 1 January 2025.
