The investigation into the Justice Fund is taking on a fresh pace. A spokesperson for the National Prosecutor's Office, Prosecutor of Przemysław Nowak, announced that the 3 suspects in this case – Fr Michał O. and 2 fund officials – were presented with fresh allegations. The prosecution besides applied for an extension of provisional detention for another 3 months. The issue that has already sparked immense controversy now becomes even more complex.

New charges

On Monday, prosecutors from the investigation squad No. 2 of the National Prosecutor's Office announced to the suspects – Fr. Michał O., Ursula D. and Karolina K. – the decision to supplement and amend the erstwhile allegations. The fresh allegation concerns participation in an organised criminal group aimed at committing crimes against property, qualified under Article 258(1) of the Criminal Code. As the PK spokesperson said:

"Prosecutions from investigation squad No. 2 PK announced present to suspects Michał O., Ursula D. and Karolina K. the decision to supplement and change the erstwhile allegations. In that order, the prosecutor made a fresh plea under Article 258 par. 1 kk, i.e. the charge of taking part in an organised criminal group aimed at committing crimes against property.’

Request for interim detention

In connection with the fresh allegations, the prosecution applied to the territory Court in Warsaw to extend the period of provisional arrest for all 3 suspects for another 3 months. After the charges were presented, the suspects were questioned.

Background

On 28 March this year, the court decided on a three-month detention for the founder of the Profeto Foundation, who received respective twelve million zlotys from the Justice Fund, and 2 women suspected in the investigation concerning this fund. On 30 April, the territory Court in Warsaw rejected the complaint against the arrest of Fr Michał Olszewski, and on 20 June this year decided to extend the temporary detention for the priest for another 3 months. At the end of July this year, the suspect's lawyer informed PAP that the Court of Appeal in Warsaw decided to shorten the detention for the suspect.

Prosecutors' allegations

Prosecutors accuse suspects that paying over PLN 66 million from the Justice Fund for the Foundation Profeto was unwarranted as the organization, according to investigators, did not meet the formal and substantive requirements to receive this money. Officials who decided to allocate these funds were to act jointly and in agreement with the president of the Foundation.
