Biernacki: War dogs – erstwhile again

myslpolska.info 2 years ago

Recently an article was published on the portal Miści Polska. "Unspoken War", in which the author described the participation of Polish mercenaries in the attack on the territory of the Russian Federation and tried to find whether Polish "dogs of war" operate under the patronage of the Polish Republic or not.

The question was asked whether the members of the Polish Volunteer Corps obtained formal consent from the Warsaw government, which, according to the author, is simply a key condition to admit or reject the work of the III Polish Republic. It is only part of the truth.

The majesty of lawlessness

There are indications that the Polish Republic did not give approval to anyone to participate in the armed forces of Ukraine. At the same time, there is no uncertainty that the III Polish Republic in the majesty of the law, or, in fact, lawlessness, as below, supports and identifies with all Poles illegally fighting on the side of Ukraine. I stress that erstwhile I compose III of the Polish Republic I mean the full parliamentary political class from the Left to the Confederacy – possibly with tiny exceptions. This is the perfida of this situation, that the law is broken by both the governing coalition and those who have the "Constitution" banners and have self-appointed defenders of the regulation of law.

If any Polish citizens joined Wagner's Group without obtaining appropriate permits from the Ministry of Defence, then, of course, the Republic of Poland would punish criminals with all its power. I deliberately utilized the word "entry" alternatively than, for example, fighting in the Wagner Group due to the fact that the offence referred to in Article 141 k.k. is formal and does not depend on any effect. It is fulfilled as shortly as the perpetrator (Polish citizen) accepts military duties in a abroad military or abroad military organisation without the consent of the competent Polish authority (§ 1) or duties in military mercenary service prohibited by global law. Of course, this is an ex officio-sanctioned crime, which means that failure to prosecute is simply a crime of a public officer's failure to fulfil his duties.

Not law, but parliamentary political will

In the case of Polish “dogs of war” fighting on the Ukrainian side, we have no uncertainty about the failure to prosecute these criminals. Prosecutors cannot explain that they do not know about this or its scale, for it is universal knowledge. The procedure has continued since 2014, and in 2022 it intensified. Long interviews are conducted with mercenaries on various tv channels, and they are described by many press titles calling them “Polish soldiers” and “heroes” – which is an aberration. In the event of the death of specified a man, he is frequently said goodbye by the authorities of Poland. Of course, those prosecutors who failed to fulfil their duties (231 kk) have their superiors, who besides have individual over them. It is highly likely that these prosecutors failed to fulfil their duties due to the fact that their bosses thwarted their criminal proceedings, i.e. there is simply a suspicion that they have committed a crime of engagement (239 kk). These bosses besides do not operate in vacuum, but in the political realities of the 3rd Republic of Poland, which, as can be seen from this example, is no longer a legal state as defined in Article 2 of the Polish Constitution.

In our state realities, not law, but political will has a superior position. After all, the full parliamentary political class doesn't care that no 1 is pursuing illegally fighting on the side of Ukrainian Polish mercenaries. Both the ‘ducks’ and the ‘constitutional defenders’, the law is dealt with in this way and is simply a tool for achieving political objectives. It is not the law which sets them the scope and principles of action, which the Constitution dictates, but on the contrary. This. they indicate erstwhile and to what degree the law is to act and erstwhile it is ‘off’. specified practices were not even in the darkest period of the Polish People's Republic. After 8 years, erstwhile the number of Poles fighting on the side of Ukraine increased rapidly, Members of all parties began to look hysterically for a solution to this problem. In December 2022, a task of abolition for Ukrainian fighters, signed by representatives of all clubs and clubs of Poland 2050 and PPS (beyond the Confederacy), was sent to the Sejm. Unfortunately, this is not an abolition task but an inept effort to change the content of Article 141 kk in violation of the rule lex retro non agit (the law does not work backwards), but first.

What is abolition

Abolition is an act of law, a bill based on which the prosecution of certain crimes committed is waived, as well as the investigation and judicial proceedings, even after the judgement has been pronounced, but before its finalisation. Abolition can only apply to crimes already committed. Abolition does not lead to legalisation of a crime, nor does it alter its legal qualifications. This is simply a one-time cancellation of penalties for those who committed a criminal offence at a circumstantial time.

The parliamentary task only defined the starting date – on February 20, 2014, after which they waived prosecution, but did not specify the closing date. Nor should the perpetrators of acts that are yet to be committed in any future be prosecuted. So this is not a task of abolition but a primitive effort to legalize crimes already committed and those to be committed. Are those Members who have submitted this task so substantively weak that they have signed up to specified a legal monster or so lazy that they have not examined what they are signing – remains unresolved. Or possibly neither, only they are rudely clever, due to the fact that they know that the trained people will accept all their foolishness, provided it harms Russia. In this way, this task must be rejected at first reading. However, it will not be done so far due to the fact that it was thrown into the “freezer”, not for substantive reasons only due to animosity inside the Law and Justice.

The opposition feigns attachment to the Constitution

The only advantage of this task is that our “state men” publically revealed that the war has been going on since 2014 and Polish citizens have been participating in it from the beginning. They besides revealed that the authorities had known this for 9 years and had broken the law without pursuing these criminals.

That until February 2022 specified a state of affairs was acceptable to the Polish authorities, due to the fact that the scale of the procedure was not besides large and it could then be "storaged under the carpet". More than a year ago, “the milk spilled” and so many Ukrainian patriots appeared with Polish citizenship ready to die on the steppes of Ukraine, that Ukrainian patriots from Wiejska now have a real problem. The electorate sees it and accepts it for now. But will he accept forever? Will it yet come to “Janów Kowalski” that the full political class thinks they are idiots? due to the fact that how else to describe the behaviour of the MPs of the Left or the PO who 1 day screams the “Constitution!” and all day together with the Law and Justice are breaking this Constitution, accepting that there is no prosecution of elected perpetrators of crimes due to the fact that that is simply a political decision. Opposition MPs are corrupting citizens even more than the Law and Justice. The Law and Justice don't play anyone, he's like that. On the another hand, opposition MPs play noble and law-abiding, better than the general public. Clearly, Polish mercenaries are protected by politicians who let them to break the law. Therefore, the full Polish political class, at least politically, is liable for the actions of our “adults” in Ukraine and will be billed for it sooner or later. But for now, Agnieszka Romaszewska is arrogant of them, praising on Twitter: “I don’t think anyone can unite Poles – only Moscow...”.

For now, people are looking at this theatre and applauding. The question is, how much longer?
