The broad right in Poland ("enemies of liberal democracy") must be taken distant from civilian rights, which is the consequence of the opinion of supporters of the implementation of the concept of "fighting democracy", openly announced by Prime Minister Donald Tusk.
We shouldn't be laughing. Last Tuesday, the Prime Minister openly indicated that we are in the process of implementing a "fighting democracy". any may have thought it was any kind of word invented by the head of government. Well, no. This concept (German: streetbare Demokratie) was established in 1937 and popularized by political scientist Karl Loewenstein. In a nutshell, the concept of "fighting democracy" assumes that liberal democracies should take the essential steps of any kind (even unconstitutionally) towards those individuals, associations or political parties who, as part of the public discourse, formulate slogans that challenge the principles of liberal democracy. Who evaluates which slogans or actions undermine the foundations of democracy in the "liberal" version? Of course, he who has the power to do so, or government. The concept of a “fighting democracy” – alongside the “repressive tolerance” formulated by H. Marcus – aims, at least in theory, to guarantee freedom and democracy. The point is that the details show something completely different: these intellectual concepts justify the force and disenfranchised civilian rights of those citizens whose views endanger the governments of the "liberal elite" or the revolutionary left. That is, they distort the essence of democracy if they are to "betone" a political arrangement without giving citizens the choice. Thus, they de facto form “citizens of the second category”.
It's not like Prime Minister Donald Tusk abruptly remembered Karl Loewenstein's old concept. The Prime Minister most likely knew what the lawyers said about this. Those lawyers who request a extremist course in the “return” of the regulation of law in Poland. An example is prof. Tadeusz Koncewicz, who was inactive present in February 2024. in ‘Rzeczpospolita’ called for... the “zeroing” of the Constitutional Court by a resolution of the Sejm. Dr. Aleksandra Gliszczyńska-Grabias, appointed by Adam Bodnar in June, is besides the concept of “a combating democracy” by Dr. Aleksandra Gliszczyńska-Grabias as the head of “The hatred speech and prejudice-motivated crimes” and includes prosecutors (including Proc. Jacek Bilewicz) and judges. As early as 2019, he warned mec of the threat of specified activities. Jerzy Kwasniewski in text for “Rzeczpospolita”.
So what can be seen in the articles on "prevention measures" from liberal democracy against threatening right-wing movements? Quotes from the article by prof. Tadeusz Koncewicz "Democracy fighting for the Constitution”: “The state cannot wait with a defence intervention until the political organization takes power and begins to introduce fresh orders incompatible with the existing Constitution. erstwhile the threat to democracy is sufficiently documented and realistic, we must act “here and now”... The authorities of the 3rd State of Poland could defend democracy in many ways. Not only by delegating anti-democracy parties, but besides by refusing, for example, marches or gatherings whose sole and main intent is to question the state's strategy and its constitutional bases or to spread hatred. erstwhile liberal Poland yet begins to realize its commitment to defensive action, it may be besides late. The minute to ban the independency March was respective years ago, not in November 2018. Then it could be more than just a symbol (although important).”
Therefore, since the rulers are entering the phase of a "fighting democracy", we should not be amazed at the takeover (using force and breaking the Constitution) of the institutions of the state. It's a prelude to what's already postulated. All indications are that dealing with groups and organisations Like the independency March Association, National Movement, All-Polish Youth, Law and Justice, Sovereign Poland, Ordo Iuris and others will enter a decisive phase soon. By all means...
