HANK! Poland will officially join the European Public Prosecutor's Office. The bill passed by the ruling coalition was signed by president Andrzej Duda. It's not only harmful, it's illegal!
Thus, Poland gave any of its competences to the Eurocrats. From now on, the European Public Prosecutor's Office, based in Luxembourg, will be conducting "criminal offences against the financial interests of the European Union". The competence fan will be very large, from money laundering to corruption to cross-border VAT fraud. However, the Act does not clearly separate all competences between the Polish prosecution and the EU. And this announces another dispute in the future that will be decided... EU tribunals.
The powers of the European Public Prosecutor's Office may besides grow over time! It's very likely! Bodnar has already stated that “Union criminal law must keep up with modern threats. We are considering extending the list of alleged Eurocrime to hatred crimes... and illegal interference in the democracy of EU associate States." Does this mean that in a fewer years after we print the meme online, we will be able to get a letter from Luxembourg with a call for questioning, after which we will hear charges? Will immigration criticism be banned at European level? This is the case in Germany, why not introduce it in Poland?
The consent to transfer the competences belonging to the Polish prosecution to the level of the European Public Prosecutor's Office is decently the consent of the blank which will let eurocrats to scope for further competences, without asking the Polish State for permission. It's the dismantling of the state! Our legal strategy is already in chaos and without it.
Furthermore, the Polish Constitution clearly indicates that the transfer of competences of the Polish State to an global organisation requires ratification by the Sejm by a qualified majority of 2 thirds of the votes. Meanwhile, the government bill passed by a simple majority. So we have a situation in which part of Polish sovereignty has been illegally surrendered. And Duda did it with Bodnar and Tuski.
