According to Onet, Prosecutor Justyna Pilarczyk, erstwhile head of the territory Attorney's Office in Wrocław, faces allegations of overexecution, which threatens her up to 10 years in prison.
The case concerns the remission of the investigation against Justyna Helcyk (pictured), then leader of the Lower Silesian Brigade of National-Radical Camp (ONR).
In September 2015, during the anti-immigrant manifestation of ONR in the Wrocław marketplace Square, Justyna Helcyk gave a speech containing content deemed anti-Semitic and Islamophobic. Among another things, she said: “We are ruled by judaic imperialists, and the visitors will slaughter us all!” and “We will not let muslim scum to destruct the Polish nation!”. In connection with these statements, an investigation was initiated on grounds of public incitement to hatred against the background of national, cultural and spiritual differences.
Initially, D.A. Pilarczyk drew up an indictment against Helcyk. However, following the intervention of the superiors, she was to retreat him from the court, arguing that the statements of Helcyk were “an expression of concern for the safety of the state and citizens.” This decision did not all meet, but Pilarczyk shortly advanced to a spokeswoman, and then to the head of the territory Attorney's Office in Wrocław.
In 2023, Justice Minister Adam Bodnar appointed a peculiar squad of prosecutors to analyse investigations from 2015-2023 in terms of their political motivation. In the squad report, Pilarczyk's case was mentioned as an example of actions that may bear the signs of a crime. The prosecution is presently examining whether Pilarczyk has not exceeded his powers, which could consequence in a conviction of up to 10 years imprisonment.
